Budget and Transfer of Posts: Health and Community Services to Children, Young People, Education and Skills: Children's Services

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Transfer of budget and FTEs from Health and Community Services (HCS) to Children, Young People, Education and Skills (CYPES) in respect of Children’s Services

Decision(s): The Treasury Minister approved the transfer of £2,002,000 and 18.82 Full Time Equivalent posts (FTEs) from the HCS Revenue Head of Expenditure to the CYPES Revenue Head of Expenditure with recurring effect from 1 January 2019.

Reason(s) for Decision:

Article 58 of the Public Finances (Jersey) Law 2019 states that the provisions of the previous Law, as they have effect immediately before the 2019 Law came into force, continue to apply to money received expended or otherwise handled by or on behalf of the States during the financial year in which this Law came into force

 

Article 18 (1A)  of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

 

Article 18(1B) of the Public Finances (Jersey) Law 2005 states that the Minister shall, after consulting the Chief Minister and PAO, give the States Assembly at least 2 weeks’ notice before an amount is transferred under paragraph (1)(c).

Article 18(1C) of the Public Finances (Jersey) Law 2005 states that before giving notice under paragraph (1B), the Minister shall, in relation to any States funded body, consult the Minister responsible for that body.

 

The written report accompanying this decision is exempt as it may allow the identification of personal data relating to individuals. The following are the business units being transferred as a result of this decision:

  • C&SS fleet
  • Psychology Services
  • Family Care Co-Ordination
  • Community Short Breaks
  • Training & Development
  • Brighter Futures
  • Systems Redesign & Delivery
  • Applications Team
  • Liberty House Rental & Other Costs

The total budget for these business units is £2,405,000. Budgets totalling £403,000 will be transferred back from CYPES to HCS, giving a net transfer of £2,002,000.

 

Resource Implications: The HCS Revenue Head of Expenditure to decrease by £2,002,000 and the CYPES Revenue Head of Expenditure to increase by £2,002,000.

 

FTEs in HCS to reduce by 18.82 and CYPES to increase by 18.82 FTEs

 

This decision does not change the total amount of expenditure approved by the States for 2016-2019 in the Medium-Term Financial Plan.

 

Action required:

The Head of Financial Governance to notify the Head of Finance Business Partnering supporting CYPES and the Head of Finance Business Partnering supporting HCS once the Decision is signed.

 

In accordance with Article 18 (1B) the Greffier of the States is requested to arrange for the attached report to be presented to the States at least 2 weeks before the transfer is concluded. After the expiry of 2 weeks following presentation to the States the transfer may be concluded.
