Ex Gratia Payment (P.130/2013) to Mr. Terry McDonald as approved by States Assembly

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  An ex gratia payment to Mr Terry McDonald, as approved by the States Assembly.

Decision(s):  The Minister approved a budget transfer of £50,000, from Central Contingency (one-off) to the Treasury and Resources (T&R) revenue head of expenditure to allow an ex gratia payment to Mr Terry McDonald in accordance with a decision by the States Assembly P.130/2013.

Reason(s) for decision: Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure to heads of expenditure or the insurance fund of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

 

The States Assembly approved P.130/2013, on the 20th November 2013, to make an ex gratia payment of £50,000 from central contingencies to Mr T McDonald as compensation for costs incurred in the setting-up of an unsuccessful charity fireworks display in the summer of 2007. The States Decision made clear that it did “not seek to try to accept or apportion any blame [on departments] for how events transpired” it was nonetheless appropriate for an ex gratia payment to be made.

 

The sum of £50,000 is required to be transferred to a department in order for the payment to be made as a payments cannot be made direct from Central Contingencies.

Resource Implications: The T&R revenue head of expenditure will increase by £50,000 in 2013 with Central Contingency (one-off) decreasing by an identical amount. This decision does not change the total amount of expenditure approved by the States for 2013.

Action required:  Business Manager to inform the Head of Financial Planning, Financial Performance Reporting Manager that this decision has been approved.
