Miss Decia Gomes De Jesus (trading as Ginger in the Central Market) was fined £2,000 in the Magistrates Court on 10th August 2021 after pleading guilty to two breaches of the COVID-19 (Workplace Restrictions) (Jersey) Regulations 2020. The breaches related to a persistent failure to wear a mask covering the nose and mouth when in the presence of a visitor and a failure to comply with an Improvement Notice served by the Health and Safety Inspectorate requiring this.
The charges related to the period between January to March 2021 when it was a condition of opening under the COVID-19 (Workplace Restrictions) (Jersey) Order 2020 that the occupier or owner of a food and drink premise required every person working at the workplace to wear a mask, covering the mouth and nose, or a visor, when in the presence of a visitor to the business.
Miss De Jesus’ street food stall was visited a number of times by both Police and the Health and Safety Inspectorate during January and February when she was not wearing a mask. At each visit she was advised of the legal obligation on her to wear a mask when serving customers.
Despite these visits, reinforced by letters advising her of the legal requirement to wear a mask and the service of an Improvement Notice, Miss De Jesus continued to serve customers without wearing a mask or visor resulting in the prosecution.
