Foreshore encroachment (FOI)

Produced by the Freedom of Information office
Authored by States of Jersey and published on 13 December 2017.

Request

Please list the addresses of coastal properties in Jersey for which a levy has been made on the grounds of encroachment following the gift of the foreshore made by the Crown to the Island of Jersey.

Response

On 12 June 2015 the Gift, Cession and Transfer of Title, Rights and Interest in Seabed and Foreshore by The Crown to the Public of the Island was passed before the Royal Court.

Since 12 June 2015, the following relevant transactions have been passed before the Royal Court, in relation to encroachments upon the Foreshore:

  • 2016 06 03 Sale of Rights to Brise de Mer, Greve d'Azette, St Clement
  • 2016 12 09 Sale of Rights to Roche de la Mer, Greve d'Azette, St Clement
  • 2017 06 30 Sale of Rights to Petit Chateau de la Mer, Havre des Pas, St Helier

The considerations, terms and conditions of these transactions were freely negotiated between the relevant parties following the result of independent valuations in each case. The Public does not impose a levy on encroachments.

Copies of all property contracts can be found in the Public Registry. The “Public Registry Index and Document Enrolment” (PRIDE) online system can be accessed either at the Judicial Greffe Public Registry, in the basement of the States Building, or at the Jersey Archive.
