As per Ministerial Decision, reference MD-T-2018-0060, on 12 November 2018 approving the establishment of the Jersey Taxi Drivers Association (JTDA) owned Taxi-Cab company "Jersey TaxiApp" as a Taxi-Cab operator that will "allow for JTDA members to affiliate".

A

Please advise how many yellow plate holders and purple Plate holders have now affiliated to the Taxi-Cab company "Jersey TaxiApp".

B

Please also advise what fare tariff is used by that Taxi-Cab company.

Also advise whether the regulatory requirements are the same as for all other Taxi-Cab companies  and if not what are the differences?

D

Please confirm that all yellow plate holders can affiliate to any Taxi-Cab company they wish to.

Also advise when the JTDA owned yellow plates will be converted to company owned red plates to remove the competitive advantage of being able to rent out their vehicles / employ drivers that can access the "Public Ranks" or when other Taxi-Cab companies will also be allowed to have "Public Rank" accessible company vehicles?

This information is exempt under Article 33 (Commercial interests) of the Freedom of Information (Jersey) Law 2011 as this data is commercially sensitive and its disclosure could be deemed to be prejudicial.

This information is exempt under Article 36 (intended for future publication) as the Driver Vehicle and Standards (DVS) section will be publishing the Fare Tariff data on the following section of the Government Website within the next 12 weeks.

The regulatory requirements are the same for all Taxi-Cab Companies.

Every yellow plate holder has the right to apply to any recognised Taxi-Cab company to request affiliation.

All Taxi-Cab plates are the property of the Minister for Infrastructure and are issued to companies or individuals who fulfil the requirements. Requests for a change to the type of plate used may be considered by Minister for Infrastructure.

Exemptions applied:

Article 33 Commercial interests

Information is qualified exempt information if –

(a) it constitutes a trade secret; or

(b) its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information).

Article 36 Information intended for future publication

(1) Information is qualified exempt information if, at the time when the request for the information is made, the information is being held by a public authority with a view to its being published within 12 weeks of the date of the request.

(2) A scheduled public authority that refuses an application for information on this ground

must make reasonable efforts to inform the applicant –

(a) of the date when the information will be published;

(b) of the manner in which it will be published; and

(c) by whom it will be published.

(3) In this Article, “published” means published –

(a) by a public authority; or

(b) by any other person.
