Costs relating to the Nightingale Hospital (FOI)

Please confirm the following regarding the Nightingale Hospital.

A

All direct and indirect costs up to 1 March 2021.

B

The length of the remaining leases and the finishing date for both the land and structure.

C

The cost of the last extension to the original leases and its length time.

The direct cost of the Nightingale Hospital are £11,246,299, split as follows:

Indirect costs involved with the project have not been tracked.

In respect of the temporary structure, the lease was for an initial four month period from 10 April 2020 and is currently being renewed on a month by month basis. All other ancillary structures and equipment associated with the structure without which it could not function are also being renewed on this basis.

Ongoing monthly costs relating to the building, ancillary structures and equipment hire are therefore £182,613 per month. This does not include security and running costs.

In respect of the licence for the land, following on from the expiry of the initial 12 month licence, this is also being renewed on a month by month basis. The cost for this is being withheld in accordance with Article 33 (b) of the Freedom of Information (Jersey) Law 2011.

A copy of the redacted licence agreement, which also withholds all personal information in accordance with Article 25 of the Freedom of Information (Jersey) Law 2011 is attached.

Article 33 Commercial interests

Information is qualified exempt information if –

(b) its disclosure would be likely to prejudice the commercial interests of a person (including the scheduled public authority holding the information).

Public interest test in respect of the licence for the land

Article 33 (b) is a prejudice-based exemption. That means that in order to engage this exemption there must be a likelihood that disclosure might cause prejudice to the interest that the exemption protects. In addition, this is a qualified exemption and consideration must be given to the public interest in maintaining the exemption.

Government of Jersey considers that releasing all the details in relation to the timescales agreed in the licence could prejudice the commercial interests of either the Government of Jersey or the other parties to the licence. There may be public interest in this commercial information however it is considered that this is not outweighed by the potential for commercial and/or financial damage.

Article 25 Personal information

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in

the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection

principles, as defined in that Law.
