An amendment was made to the Planning and Building (General Development) (Jersey) Order 2011 made 16/12/15 coming into force on 13 January 2016 (R&O160/2015) so that in Part 7 Schedule 1 sub-paragraph (e), the words “or commercial” shall be deleted. Can you please provide me with all the documentation relating to why this decision was made.
Response
Ministerial Decisions (MD) were made in 2015 authorising that amendments could be made to the Planning and Building (General Development) (Jersey) Order 2011.
The word ‘commercial’ was removed from Part 7, Class A, (e) so that whereas the demolition of domestic glasshouses would remain a permitted development, the demolition of all commercial glasshouses would now require an application for planning consent. The reason for the change was due to the high risk of land contamination arising from the use of commercial glasshouses, meaning that remediation is needed before land could be put to another use.
