Please can you share how many children the government has assisted to move/ live outside of Jersey under the CHILDREN (JERSEY) LAW 2002 - since the law was introduced?

In order to complete your request, information has been obtained from 2014 to date. To extract the information prior to this would exceed the cost limit provisions allowed under Article 16 of the Freedom of Information (Jersey) Law 2011 and the 12.5 hours limit allowed under regulation 2 (1) of the Freedom of Information (Costs) (Jersey) Regulations 2014.

38 children and young people who are looked after have been placed off-island since 2014.

It is determined that to provide figures where there are fewer than five would breach the privacy of those individuals therefore Article 25 (Personal Information) of the Freedom of Information (Jersey) Law 2011 has been applied.

It is determined that to extract this information and crosscheck records would exceed the cost limit provisions allowed under Article 16 of the Freedom of Information (Jersey) Law 2011 and the 12.5 hours limit allowed under regulation 2 (1) of the Freedom of Information (Costs) (Jersey) Regulations 2014.

Since 2014, eight children and young people have been placed with parents/guardians off-island.

Since 2014, 18 children and young people have been placed in residential care facilities off-island.

Since 2014, 18 children and young people placed in residential care facilities off-island have been placed in therapeutic units.

Since 2014, 12 children and young people have been placed off-island with Foster Carers that were not parents/guardians.

Since 2002, £29.6m has been spent facilitating off-island placements for children and young people.

There are currently 19 children and young people placed off-island.

Article 16 – A scheduled public authority may refuse to supply information if cost excessive 

A scheduled public authority that has been requested to supply information may refuse to supply the information if it estimates that the cost of doing so would exceed an amount determined in the manner prescribed by Regulations

Article 25 - Personal information 

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2005.

(2) Information is absolutely exempt information if – 

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2005; and 

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
