(i) and (ii) Health and Community Services considers it likely that the disclosure of this information would prejudice the commercial interests of the authority and as such Article 33 of the Freedom of Information (Jersey) Law 2011 has been applied.

Article 33 - Commercial interests 

Information is qualified exempt information if –

(a)     it constitutes a trade secret; or

(b)     its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information). 

Public Interest Test 

When applying Article 33: Commercial Interests, Health and Community considered that the current contract with the supplier ends in early 2024 and as such there will soon be a requirement for the authority to consider its options in relation to the supplier and the system requirements. 

The disclosure of the cost of the contract was seen as likely to disadvantage the authority in any future tender process. Therefore, whilst it is in the public interest to disclose the costs of contracts, in this instance, it is considered that this is outweighed by the public interest in securing the best value for the taxpayer, and the information is to be withheld.
