It would be most appreciated if you would kindly post to me a copy of the contract Jersey Property Holdings has issued to a contractor, to carry out works at Le Clos des Fonds, Grouville. The works commenced approximately 18 March 2015. Your earliest possible reply will be appreciated.

Below is an extract from the 2016 landscape contract in relation to Le Clos des Fonds, which provides details of tasks undertaken by the landscaping contractor, employed by Jersey Property Holdings, and how regularly those tasks are to be undertaken, together with a plan showing the areas, highlighted in green and purple, to which these tasks apply.

FOI exemption(s) applies:

Freedom of Information (Jersey) Law 2011: Part 5: Qualified Exempt information: Article 33 Commercial Interests

Information is qualified exempt information if:

a it constitutes a trade secret; or

b its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information)

Article 33 is a Qualified Exemption and therefore is subject to a Public Interest Test.

Justification for the exemption:

The information is of significant commercial value and its disclosure would, or would be likely to, prejudice the commercial interests of the third party and the scheduled public authority.
Therefore it is considered that it would not be in the public interest to release this information at this time and this exemption should be maintained.
