Health and Community Services (HCS) does not follow the fiscal year observed in the NHS. Data provided relates to the complete financial year 2023.

Much of the information requested has been provided in previous Freedom of Information responses. Where information is available elsewhere, Article 23 of the Freedom of Information (Jersey) Law 2011 has been applied. Notes are included in the table to identify where this exemption applies and the date of the published response containing the requested information, as linked:

Notes are included in the table to identify other instances where requested information is exempt under Freedom of Information legislation. Where appropriate, published information has also been signposted.

Where table notes indicate that information on shifts or hours worked is not available in a central record, identifying the data would require manual analysis of all team or department rosters for the relevant staff groups and / or timesheet submissions for individual agency staff contracted by HCS across the year.

A Scheduled Public Authority is not required to create new datasets nor manipulate existing datasets in order to respond to Freedom of Information requests. Furthermore, the time necessary to identify and extract the data requested from the records that are available would exceed the timescales prescribed in the Freedom of Information (Costs) (Jersey) Regulations 2014. Therefore, Article 16 of the Freedom of Information (Jersey) Law 2011 has been applied.

Note 1:

Non-Medical / Non-Clinical Bank and Agency staff are not managed through a central team, and as such, there is no single point of contact.

Note 2: 

HCS uses CONNECT Enterprise Resource Planning. Non-Medical / Non-Clinical agency staff providers may utilise Vendor Management Systems, though no central record of this is held. Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

Articles Applied

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.

Article 16 - A scheduled public authority may refuse to supply information if cost excessive

(1) A scheduled public authority that has been requested to supply information may refuse to supply the information if it estimates that the cost of doing so would exceed an amount determined in the manner prescribed by Regulations. 

Article 23 - Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.​
