​Regarding the planning application refusal referenced RC/2024/0600, please advise how many times, planning officer [name redacted] has successfully or attempted to remove ‘Permitted development rights’ since the beginning of 2020.  This information would be contained on ‘Decision notice’ of any application they have been involved with.

Response

The planning team within Infrastructure and Environment does not maintain a list of specific officers in relation to ‘Permitted development rights’.  The Freedom of Information (Jersey) Law 2011 does not require a Scheduled Public Authority to manipulate data in order to provide a response.  Therefore, Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

However, the information is accessible on www.gov.je within the planning register which will enable collation of the requested information.  Therefore, Article 23 of the Freedom of Information (Jersey) Law 2011 has been applied.

​Searches relating to specified periods, e.g. month, can be carried out within the planning register and all applications are marked major or minor.  The register also allows you to view approved and pending cases.

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.

Article 23 - Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.​
