Please provide the terms of reference for the States Employment Board's review of remuneration (including bonuses) to the Chief Executives of States Owned Entities.

Article 35 - Formulation and development of policies

Information is qualified exempt information if it relates to the formulation or development of any proposed policy by a public authority.

Public Interest Test

Article 35 is a qualified exemption, which means that a public interest test is required to be undertaken by the SPA. It is therefore necessary for the SPA to examine the circumstances of the case. Following assessment, the SPA must decide whether, on balance, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.  

Although there is a need for transparency, accountability, and good decision making by public authorities this information relates to potential policy changes and the building of a Remuneration Policy Framework which will need to be negotiated between the Government of Jersey and other parties.  

The Government of Jersey needs time to research and pull together a draft policy which at this time is still being researched. 

On balance, it has been concluded that the public interest does not outweigh the potential prejudice of release at this time, as it could affect future negotiations with Arm’s Length Organisations and States Owned Entities. ​
