14 Duhamel Place, St Helier - retained as building of local interest

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision:

The particular interest of 14 Duhamel Place, St Helier, as identified and described in the report and relative to the published criteria for selection justifies its retention on Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest.

Legal and Resource Implications:

The inclusion of buildings and places in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey is consistent with the purposes of the Planning and Building (Jersey) Law 2002.

Purpose of the Report

To seek to confirm the intention to maintain 14 Duhamel Place, St Helier as a Building of Local Interest (BLI) on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey. 

Background and discussion

On the basis of an appeal to remove this building from the Register (see appendix 1) it was previously determined, on the basis of a report on the matter prepared by Jersey Heritage dated 19 October 2009 (@ appendix 2) that 14 Duhamel Place, St Helier was of sufficient interest to warrant its retention on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest. Notices of the Minister’s intent were served on the owner’s agent on 06 January 2010 in order to provide an opportunity for representations to be made. 

No further representations have been received but the original appeal still remains valid and sets out the grounds of appeal (see appendix 1). 

Jersey Heritage’s assessment supports the retention of this building on the Register on the basis that it meets the criteria for registration. This view is unanimously supported by the Ministerial Registration Advisory Group. 

Legal and resource implications

The inclusion of buildings and places in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey is consistent with the purposes of the Planning and Building (Jersey) Law 2002. 

Recommendation

The Jersey Heritage recommendation of Jersey Heritage is to maintain 14 Duhamel Place, St Helier as a Building of Local Interest in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey. 

Reason(s) for Recommendation

The particular interest of 14 Duhamel Place, St Helier as identified and described in the report and relative to the published criteria for selection, justifies its inclusion on Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest.
