2007 Capital Budget Transfers

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister:

· noted the allocation of the infrastructure capital vote of £4.5 million to Sewers (£1m), Highways (£2.655m), Sea Defences (£0.405m) and Odour Control (£0.440m);

· approved the Department’s 2007 Minor Capital Allocation of £350,000 and the Transport Section’s 2006 Minor Capital Allocation of £50,000 (Capital Vote C2685) be used to fund the fitting out of the Transportation Centre.

· approved the closure of existing capital votes with the unspent balance being used to fund boiler tubes (£250k), traffic model (£113k) and Vaporisation area at La Collette (£50k); and

· requested the Minister for the Treasury and Resources Department approves all the budget transfers as detailed in the body of this report.

Reason(s) for decision:

To ensure compliance with Finance Direction 3.6.

Action required: The Finance Director:

· to request the Minister for the Treasury and Resources Department to approve all transfers of the decisions referred to in this report.

2007 CAPITAL BUDGET TRANSFERS

Purpose of the Report

The purpose of this report is to notify the Minister of the annual allocation of the Transport and Technical Services Department’s 2007 Infrastructure and Minor Capital Votes and to seek his approval to a number of capital budget transfers.

Background

Finance Direction No.3.6 ‘Variations to Heads of Expenditure’ sets out the procedures for the transfers between capital heads of expenditure and states that transfers of capital in excess of £100,000 require the approval of the Minister for Treasury and Resources and the relevant Minister party to the transfer.

Discussion

Infrastructure Maintenance Vote (£4.5 million)

For the first year the Transport and Technical Services has received a single allocation for Infrastructure Maintenance which will be used to fund Highways, Sea Defence, Sewer (and Odour Control) projects.

The TTS Programme Board met to decide on the annual infrastructure allocation and after reviewing its existing capital votes and discussing the individual capital requirements of each directorate it was agreed that the budget should be apportioned to the following areas:

The Minister will be aware that the Transport and Technical Services Department was tasked by the States with fitting out the Transportation Centre Building which will be used by the Bus Operator.

The estimated cost of fitting out the Transportation Centre is £631,700 of which the department currently has ‘ring-fenced’ funds of £231,700 (Capital Vote C2685). It is recommended that the balance required of £400,000 is funded from the Department’s 2007 Minor Capital Allocation of £350,000 and the Transport Section’s 2006 Minor Capital Allocation of £50,000 (Capital Vote C2685).

Closure of Existing Capital Votes:

At the end of 2006 the TTS Programme Board reviewed all its existing capital projects and is requesting that the capital votes shown below be closed.
