Les Quennevais School: Approval of drawings and acceptance of stage 1 tender

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

(a)  In accordance with Standing Order 168 (1) (d), the Minister, approved the drawings and specifications listed below all showing the proposed Enabling Works, as recommended by Jersey Property Holdings.

(b)  The Minister agreed to accept the lowest fixed price tender submitted by RoK-Regal Limited in the sum of £4,876,535.49 for the Stage 1 Enabling Works and Pre-Construction Services Agreement (PCSA) Fee; and enter into a formal JCT 2011 Contract.

(c)   Based upon the tendered “fixed rates and prices” for the second stage, enter into  negotiations with Rok-Regal Limited to determine an affordable price for the Main School Building in readiness to enter into a separate JCT Contract under a separate Ministerial Decision at a later date.

Reason(s) for Decision:

The key drawings noted in item (a) above and which Planning approval has been granted (Permits P/2017/1015) reflect the use for which the funding is provided.

Under Standing Order 168 (1) (d), it is a requirement for the Minister for  to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

The approved Procurement Strategy adopted a two-stage tender approach.  The subsequent approval of the second stage and continuation project will require an affordable cost plan to be developed with the Contractor that fits within the allocated budget.

At this point, the lowest Stage 1 tender submitted by Rok-Regal in the sum of £4,876,535.49 can be accepted and a contract entered into.

Resource Implications:

  1. The budget is comprised of the capital budget relating to Les Quennevais School (FXA071). The financial implications of this decision are detailed in the accompanying and approved Tender Evaluation report.
  2.       There are no additional manpower implications in respect of this decision.

Action required:

Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.
