Rue des Pres Trading Estate: Traffic Order: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Preparation of the Rue des Pres Trading Estate Traffic Order so that parking charges and restrictions can be introduced.

 

Decision(s): The Minister instructed his officers to request the Law Draftsman to prepare the Rue des Pres Trading Estate Traffic Order which will include prohibited parking, zone parking, restricted zone parking and pay-card parking.

Reason(s) for Decision: To control and charge for parking in Rue des Pres Trading Estate to improve road safety and maintain the roads.

 

Resource Implications: Law Draftsman and DfI Officer time will be required to prepare the Order for making by the Minister, but once made costs for maintaining and improving safety of the roads can be recouped through parking charges.

 

Action required: Senior Engineer to write to the Law Draftsman to request the Rue des Pres Trading Estate Traffic Order be prepared for the control of parking on Rue des Pres Trading Estate when those roads become States of Jersey Main Roads.

RUE DES PRES TRADING ESTATE TRAFFIC ORDER

 

 

 

Purpose of the Report

 

To instruct the Law Draftsman to draft a Traffic Order for Rue des Pres Trading Estate so that parking charges and restrictions can be introduced.

 

 

Background

 

The Minister for Infrastructure authorised his staff to arrange for the Rue des Pres Trading Estate Roads to become Grande Routes or States of Jersey Main Roads on 5th April 2016 under MD-PH-2016-0023. By converting these roads to States of Jersey Main Roads, parking can be charged for and controlled under the Road Traffic (Jersey) Law 1956.

 

 

Discussion

 

The roads that make up Rue des Pres Trading Estate are L’Avenue le Bas, La Rue Martel, La Rue Grellier, La Rue Sinatt and La Rue le Gros. Once these roads become Grande Routes, then the Minister for Infrastructure can make Orders to implement parking restrictions.

 

After consulting with the Law Draftsman and the Law Officers Department, it has been determined that a Rue des Pres Trading Estate Traffic Order should be prepared with a number of parking restrictions included.

 

Four types of parking restriction will be required to ensure that parking on the proposed Public Highway is controlled to improve safety, the public are financially compensated for the use of the Public Highway by users of the estate and that businesses can continue to operate, much as they do at present.

 

The four restrictions are:

 

  • Permit parking in zones immediately adjacent to a premise, zones for which the parking permits issued are restricted to, and controlled by that adjacent land owner or tenant, because such parking blocks access to the adjacent unit.
  • Permit parking in zones anywhere within the estate roads to be allocated to businesses on a yearly basis.
  • Pay card parking zones.
  • Prohibited parking or yellow lines.

 

After consultation with the businesses and residents of Rue des Pres Trading Estate drawings and a schedule have been prepared which allocate sections of the roads to the various restrictions as described above.

 

 

 

 

 

 

Conclusion

 

By adopting a parking regime that includes the four parking restrictions described above, the public will be able to charge for and control parking on the estate, while allowing businesses to continue to operate in the way they currently do.

 

 

Recommendation

 

The Minister is recommended to instruct his officers to request the Law Draftsman to prepare the Rue des Pres Trading Estate Traffic Order which will include prohibited parking, zone parking, restricted zone parking and pay-card parking.
