Connex - Shift Allowance Settlement and Contract Extension.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

3.2.1(a)(xi)

Subject: Proposals to settle the shift allowance issue and also to extend both the scheduled and schools / leisure services for a further three years from their expiry in 2009 to 2012.

Decision(s):

The Minister:

  1. Approved the proposal to settle the shift allowance issue by Connex reducing the contract payment by £200,000 before the end of the current contract in September 2009;
  2. Approved the various elements detailed in this report to extend the contracts for both the scheduled and schools / leisure service by three years to 2012; and
  3. Requested the Law Officers to draw up the necessary documents for signature.

Reason(s) for Decision:

  1. This resolves the shift allowance issue which has been outstanding since 2002/3.
  2. The extension of the contract provides a positive return to the States and tangible benefits to the travelling public.
  3. Extending the contracts will allow further time to assess the impact of integrating the network and defining the network to be re-tendered for 2012.
  4. The savings accruing will be reinvested in the bus service or utilised to provide contractual and technical support in preparation for the contract award in 2012.

Resource Implications:

There are no additional financial implications as a result of this decision and any resultant savings will be reinvested into the bus service or used in preparation for the retendering exercise ahead of the 2012 contract award. 

Action required:

  1. Prepare a statement for the Minister’s approval to be presented to the States on 3 June 2008.
  2. Prepare a media release to be embargoed until the Minister has delivered his statement in the States.
  3. Request the Law Officers to prepare the necessary documents for signature
