Petroleum (Licensing) (Fees) (Amendment No. 2) (Jersey) Order.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Petroleum (Licensing) (Fees) (Amendment No. 2) (Jersey) Order

Decision(s):

The Minister made the Petroleum (Licensing) (Fees) (Amendment No. 2) (Jersey) Order to require the payment of a fee for licences to keep petroleum spirit.

Reason(s) for Decision:

This Order increases the fees in relation to licences to keep petroleum spirit by an average 9%, since they were last increased on 19th May 2006. Increases are within inflationary limits and do not require further approval.

Resource Implications:

The charges are set at a level to recover costs; there are no further resource implications to the Home Affairs Department

Action required:

The Executive Officer, Home Affairs to forward the signed and sealed Order to the Publications Editor at the States Greffe, and to request that the Order be notified to the States.

THE MINISTER FOR HOME AFFAIRS, in pursuance of Articles 3(3) and 11 of the Petroleum (Jersey) Law 1984, orders as follows 

1 Article 1 amended

In Article 1 of the Petroleum (Licensing) (Fees) (Jersey) Order 2001 –

(a) in paragraph (a) for the amount “£108” there is substituted the amount “£118”;

(b) in paragraph (b) for the amount “£134” there is substituted the amount “£146”; and

(c) in paragraph (c) for the amount “£161” there is substituted the amount “£175”.

2 Revocation

The Petroleum (Licensing) (Fees) (Amendment) (Jersey) Order 2006 is revoked.

3 Citation and commencement

This Order may be cited as the Petroleum (Licensing) (Fees) (Amendment No. 2) (Jersey) Order 2009 and comes into force on 1st May 2009.
