Approval of revenue to capital transfer within Transport and Technical Services Department.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister agreed to approve the transfer of budget totalling £450,000 from Transport and Technical services revenue to Transport and Technical Services Capital (La Collette Phase II) in 2008.   

Reason(s) for Decision:

Finance Direction No.3.6 ‘Variations to Heads of Expenditure’ requires that for transfers of budget between revenue and capital heads of expenditure in excess of £100,000 are approved by the Minister for Treasury and Resources and the relevant Minister party to the transfer.

Resource Implications:

Other than those detailed in the report there are no further financial or manpower implications.

TRANSPORT AND TECHNICAL SERVICES  

TRANSFER BETWEEN REVENUE AND CAPITAL HEADS OF EXPENDITURE  
 

Purpose of the Report

The purpose of this report is to seek the Minister for Treasury and Resources approval to a request for a budget transfer amounting to £450,000 between a revenue and capital head of expenditure in Transport and Technical Services department.

Background  

A business case was approved supporting the transfer of responsibilities for engineering and municipal services from Jersey Harbours to Transport and Technical Services. 

In order to facilitate the service transfer it was agreed that building works totalling £1.8 million would be required at La Collette and Bellozanne.  The funding was to be taken from existing unspent TTS Capital Votes and paid back from future rental income generated from the letting of the vacated Harbours building.  The agreed funding solution was as follows: 

  1. Create a new capital head of expenditure in TTS called ‘Harbours Transfer.’

 

  1. Transfer a total of £1.8 million into this new head of expenditure from the following capital votes:

 

La Collette Phase II

£   600,000

Sludge Phase 1 Thickener 

£1,200,000

Total

£1,800,000

 

  1. Require Jersey Harbours to make a capital repayment to TTS on the 1st January each year for the following amounts.

 

2008 -  £450,000

2009  - £450,000

2010 - £450,000

2011 - £450,000 

  1. Transfer the capital repayments to the La Collette Phase II and Sludge Phase 1 Thickener over the four year period 2008 – 2011.

 

Discussion 

The Transport and Technical Services department have received the 2008 repayment from Jersey Harbours and has also now received approval of the Minister for the budget transfer between revenue and capital amounting to £450,000. 

The approval of the Minister for Transport and Technical Services (MD-T-2008-0063) is attached  

However, Finance Direction No.3.6 ‘Variations to Heads of Expenditure’ sets out the procedures for the transfers between revenue and capital heads of expenditure  and states that budget transfers in excess of £100,000 require the approval of the relevant Minister party to the transfer and also the Minister for Treasury and Resources. 

Recommendation 

To approve the transfer of budget totalling £450,000 from Transport and Technical services revenue to Transport and Technical Services Capital (La Collette Phase II) in 2008.
