Grant to Aids Care Education and Training (Jersey) from the Drugs Trafficking Confiscations Fund

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Treasury and Resources approved a grant of £38,250 to ACET (Jersey) from the Drugs Trafficking Confiscations Fund to support their prison education programme “Wise up to Blood Borne Viruses” in 2011 only.

Reason(s) for Decision: 

The Minister for Treasury and Resources is empowered to make grants from the DTCF under Article 24 of the Drugs Trafficking Offences (Jersey) Law 1988, following consultation with the Attorney General and with such other persons or bodies as he considers appropriate.

Resource Implications:

There is no overall increase to States spending or manpower as a result of this decision.

GRant to Aids Care Education and Training (ACET) (JERSEY) from the drugs trafficking confiscations fund

 

  1. Purpose of Report

 

To enable the Minister for Treasury and Resources to approve the award of a grant of £38,250 to Aids Care Education and Training (ACET) (Jersey) from the Drugs Trafficking Confiscations Fund (DTCF) to support their prison education programme called ‘Wise Up to Blood Borne Viruses’ in 2011.

 

  1. Background

 

ACET has been running an educational programme at the prison called ‘Wise Up to Blood Borne Viruses’ with the support of Home Affairs and Health and Social Services since 2007.  This is based on the National AIDS Trust Framework for Best Practice in Tackling Blood Borne Viruses in Prisons. The programme has been managed by a multi-agency steering group and has produced regular performance statistics and evaluation reports.

 

The programme was initially funded for 2 years from the DTCF with the intention of securing permanent funding to continue the programme from the relevant ministerial department budgets.

 

  1. Funding request

 

Home Affairs and Health and Social Services support the continuation of the programme but are unable to make recurring funding available at this time in the context of financial constraint. The programme is facing immediate closure without further funding.

 

The £38,250 which has been requested will provide 2 part time staff, educational materials and overheads for 2011 only.

 

The DTCF has sufficient balances to fund this request and use of the DTCF for this purpose is supported by the Attorney General.

 

  1. Recommendation

 

The Minister for Treasury and Resources is recommended to approve the request for £38,250 and make a grant to ACET (Jersey) from the DTCF in the sum requested to support this educational programme for the calendar year 2011 only.

The Treasury and Resources Minister is empowered to make grants from the DTCF under Article 24 of the Drugs Trafficking Offences (Jersey) Law 1988, following consultation with the Attorney General and with such other persons or bodies as he considers appropriate.

 

 

 

  1. Resource Implications

 

ACET wish to continue the ‘Wise Up’ programme beyond the term of this grant. The DTCF is not an appropriate source of recurring funding and any future commitment should be negotiated through a sponsoring ministerial department.
