The Communications (Television Licensing) (Amendment) Regulations 2019

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision and reason for the decision

The Deputy Chief Minister has been provided with a copy of The Communications (Television Licensing) (Amendment) Regulations 2019. The Secretary of State for Digital, Culture, Media and Sport sets regulations for television licence fees each year under authority of the Broadcasting and Communications (Jersey) Order 2004. The regulations come into force on the 1st April 2019 and have effect in respect of TV licences issued on or after 1st April 2019. The Deputy Chief Minister approves the registration of the Regulation.

Resource implications

There are no resource implications for the States of Jersey as a result of this decision.

Action required

The Law Officers’ Department and  External Relations Ministry to be informed of the Minister’s approval.

The Secretary of State makes these Regulations in exercise of the powers conferred by sections 365(1) and (4) and 402(3)(a) and (c) of the Communications Act 2003 (“the CA 2003”)(([a])), including as extended by—

(a)      the Communications (Bailiwick of Guernsey) Order 2003([b]);

(b)     the Communications (Jersey) Order 2003([c]);

(c)      the Communications (Isle of Man) Order 2003([d]);

(d)     the Communications (Bailiwick of Guernsey) Order 2004([e]);

(e)      the Broadcasting and Communications (Jersey) Order 2004([f]).

The Treasury has consented to the making of these Regulations in accordance with section 365(6) of the CA 2003.

Citation, commencement and effect

  1. —(1) These Regulations may be cited as the Communications (Television Licensing) (Amendment) Regulations 2019.

(2)  These Regulations come into force on 1st April 2019.

(3)  These Regulations have effect in respect of TV licences issued on or after 1st April 2019.

Amendment of the Communications (Television Licensing) Regulations 2004

  1.  The Communications (Television Licencing) Regulations 2004([g]) are amended in accordance with regulations 3 to 6.

Amendment of Schedule 1

  1. —(1) The Table in Schedule 1 (issue fees for TV licences) is amended as follows.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Communications (Television Licensing) Regulations 2004 (S.I. 2004/692) by providing for increases in—

(a)      the amount payable for certain categories of TV licence, and

(b)     the amount of each instalment for certain categories of TV licence which are payable in instalments.

In summary—

(a)      the amount payable for a basic colour TV licence is increased from £150.50 to £154.50 and for a basic black and white TV licence is increased from £50.50 to £52.00 (see regulations 3 and 6);

(b)     the instalments for a budget instalment licence and for an easy entrance licence are increased so that in each case the total amount payable is increased from £150.50 to £154.50 (see regulation 4);

(c)      the instalments for a premium instalment licence (a colour TV licence payable in quarterly instalments) (not available in the Channel Islands or the Isle of Man) are increased so that the total amount payable is increased from £155.50 to £159.50 (see regulation 4);

(d)     the amount payable for each month for a colour interim TV licence (relevant to any person who is 74 years of age and who will therefore become eligible for a free licence in less than a year) is increased from £12.542 to £12.875 and for a black and white interim TV licence is increased from £4.208 to £4.333 (interim licences are not available in the Channel Islands or the Isle of Man) (see regulation 5).

(e)      the instalments for a simple payment plan licence (not black and white only) are increased so that the total amount payable is increased from £150.50 to £154.50 (see regulation 4).

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
