Digital Switchover from Analogue – Initial Steps.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister has recommended to the UK Department of Culture, Media and Sport that the regional name for the Digital Switchover programme should be “Channel Islands Digital Switchover”.

The Minister has recommended to Ofcom dates which should be avoided for Digital Switchover to take place.

Reason(s) for Decision:

The Minister, having considered the recommendations in the report on the Initial Steps for Digital Switchover, believes that this is the best way forward for Jersey. There are significant benefits in working with Guernsey on this project, and possible disruption can be minimised by forewarning the UK Authorities of particular time periods to be avoided, such as election periods.

Resource Implications:

There are no financial or manpower resource implications with this decision.

Action required:

The Director of Regulatory Services to consult with Guernsey authorities and jointly advise the UK Department of Culture, Media and Sport of the Islands decision that the regional name for the Digital Switchover programme should be “Channel Islands Digital Switchover”.

The Director of Regulatory Services is to advise Ofcom of the Minister’s recommendation for dates which should be avoided for Digital Switchover to take place.

The Initial Steps

When discussions originally commenced on Digital Switchover, the Channel Islands were advised that this would take place in the first quarter of 2013, this being the end of the Digital Switchover programme for the UK. 

In March 2005 the French Government introduced legislation which stated that analogue transmissions would cease at the end of 2011. The French are currently installing low power digital transmitters across the country, with approximately 85% of France now being covered. However, they have yet to publish any programme for moving to high power, and Ofcom does not anticipate that such a programme will be published before October 2008. 

Depending on progress made by the French with their Digital Switchover programme, the switchover date for the Channel Islands could be advanced to the spring of 2010.

Nevertheless the current aim is for implementation to take place during 2011, with a guaranteed date before the end of 2012. 

To enable the initial steps to be taken, the Minister is asked to consider the following: 

  • A regional name for the Digital Switchover programme.

The options available are the “Channel Islands” or separate projects for Jersey and Guernsey. The benefits in running the programme under the “Channel Islands” banner are:

  • To avoid possible confusion as switchover will happen simultaneously in all the Islands.
  • The cost implication of running different Public Information Programmes if separate projects are considered.
  • To acknowledge the level of cooperation that has already taken place between the Islands on this project.

 

  • Dates to avoid for Digital Switchover.

Without more precise information on the technical constraints influencing the switchover date for the Channel Islands, there is a need to consider the period between the earliest switchover date of spring 2010 and the guaranteed latest date of 2012. Possible dates to be avoided are:

  • Peak tourist seasons due to any possible disruption in hotels, guest houses etc. As well as Easter and the peak months of June, July and August, it is worth taking into consideration the timings of festivals such as the Jersey International Air Display scheduled annually for early September.
  • The period around general elections in the Islands. These are scheduled in Jersey for September / October / November 2011 and in Guernsey for April / May 2012.
