Premium Cabs Jersey: Recognition of Taxi-Cab Company

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister agreed to recognise Premium Cabs Jersey, a registered business, as a Taxi-Cab Operator to which Taxi-Cab licence holders can affiliate.

 

Reason(s) for Decision:  To enable the Minister in accordance with Article 38 of the Motor Traffic (Jersey) Law 1935, to maintain an adequate cab service, and allow a new Taxi-Cab Operator to provide a service to the travelling public.

Action required: Head of DVS to notify Premium Cabs Jersey of the recognition as a Taxi-Cab Operator.

GROWTH, HOUSING AND ENVIRONMENT

 

RECOGNITION OF TAXI-CAB COMPANY – PREMIUM CABS JERSEY

 

 

Purpose of the Report

 

To request the Minister to recognise Premium Cabs Jersey as a Taxi-Cab Operator.

 

 

Background

 

In line with the programme of reforms set out in MD-T-2015-0079, to allow for a more flexible Taxi-Cab service, a new operator has applied to set up a new taxi-cab service under the name of Premium Cabs Jersey.

 

 

Discussion

 

Premium Cabs Jersey have committed to operate the majority of their service at peak times, with an initial fleet of five vehicles, two of which will be Wheelchair Accessible. As well as complying with current regulation they will also be utilising App technology for dispatch and booking. The company is being set up by a driver with over 20 years’ experience in the industry, which they intend to use to develop the business as it grows and builds a customer base.

 

 

Recommendation

 

The Minister is recommended to recognise Premium Cabs Jersey as a Taxi-Cab Operator.

 

 

Reason(s) for Decision

 

To allow a new Taxi-Cab Operator to provide a service to the travelling public in accordance with the Minister’s policy.

 

 

Action Required

 

Inspector of Motor Traffic will notify Premium Cabs Jersey of the decision and take any further action necessary.
