Revocation of two Orders under the Diseases of Animals (Jersey) Law 1956

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister agreed that the Diseases of Animals (Therapeutic Substances) (Jersey) Order 1958, and the Foot and Mouth Disease (Sera and Glandular Products) (Jersey) Order 1958, should be revoked.

Reason(s) for Decision:

It is no longer appropriate to licence the manufacture or importation of any therapeutic substance as required under the Diseases of Animals (Therapeutic Substances) (Jersey) Order 1958 and regulate the use of sera and other substances under the Foot and Mouth Disease (Sera and Glandular Products) (Jersey) Order 1958 when the Medicines (Jersey) Law 1995 over-rides the Orders.

Purpose of the Report  

It is proposed that the Planning and Environment Minister make an Order to revoke the Diseases of Animals (Therapeutic Substances) (Jersey) Order 1958 and Foot and Mouth Disease (Sera and Glandular Products) (Jersey) Order 1958:  

Background 
 
The Diseases of Animals (Therapeutic Substances) (Jersey) Order 1958 prohibits the manufacture for sale or importation into Jersey of any therapeutic substance as described in Article 1 of the Order, except under and in accordance with a licence granted by or on behalf of the Minister for Planning and Environment.  

The Foot and Mouth Disease (Sera and Glandular Products) (Jersey) Order 1958 regulates the labelling and use of sera and glandular products.  

The Medicines (Jersey) Law 1995 definition of “medicinal product” under Article 2 of the Medicines Law covers the definition of therapeutic substances as set out in the Diseases of Animals (Therapeutic Substances) (Jersey) Order 1958 and any glandular extract or serum mentioned in the Foot and Mouth Disease (Sera and Glandular Products) (Jersey) Order 1958.  

Discussion  

The Medicines (Jersey) Law 1995 over rides the Diseases of Animals (Therapeutic Substances) (Jersey) Order 1958 and Foot and Mouth Disease (Sera and Glandular Products) (Jersey) Order 1958. It is therefore appropriate to revoke the two Orders and remove any duplication of work in States departments.

Conclusion  

The existing legal provision under the Medicines (Jersey) Law 1995 will maintain the high standards in the island whilst ensuring that the level of control is appropriate.  

Recommendation  

The Minister is recommended to make an Order to revoke the Diseases of Animals (Therapeutic Substances) (Jersey) Order 1958 and Foot and Mouth Disease (Sera and Glandular Products) (Jersey) Order 1958:
