Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision and Reason(s) for Decision: The Minister for Home Affairs appointed Advocate Debbie Corbel as a legally qualified member or the Criminal Injuries Compensation Board. This appointment brings the total membership to 9. According to the regulations, the maximum number of members the Board may have is 12, not less than 3 of whom shall be advocates or solicitors. The resignation of a former legally qualified member in late 2020 meant that it was necessary to appoint another legally qualified member to the Board.
Resource Implications: Membership of the Board is undertaken on an honorary basis, accordingly there are no resource implications as a result of this decision.

Background

The Criminal Injuries Compensation Scheme is administered by the Criminal Injuries Compensation Board. The scheme was most recently amended in April 2015 and can be viewed via the following link:

CICB scheme

The Scheme provides that the Board will consist of not more than twelve members, not less than three of whom shall be advocates or solicitors of the Royal Court of not less than five years’ standing. Members of the Board are appointed by the Minister for Home Affairs, for five years in the first instance, and their appointment is renewable for such periods as the Minister may think appropriate. One Member, who is an advocate or solicitor of not less than five years’ standing, is appointed by the Minister as Chairman of the Board.

Membership of the Board is undertaken on an honorary basis.

Recruitment

Following the resignation of a former legally qualified member of the Board, the role was advertised through the Jersey Law Society. Debbie Corbel made an application and duly met with Officers from the Justice and Home Affairs Department.

This process has been undertaken in accordance with Government of Jersey recruitment policy and has resulted in a recommendation to appoint Advocate Debbie Corbel as a Legal Member of the CICB.

Advocate Debbie Corbel

Advocate Corbel was educated in Jersey.

Upon completing her legal training, she returned to Jersey, where in 2008 and she became an Advocate of the Royal Court. She has practised both criminal and civil litigation.

Advocate Corbel is a member of Jersey Children’s Panel and represents the Law Society in various working parties including a group responsible for the drafting and implementation of the new draft Criminal Procedure Law.

Advocate Corbel is a Senior Associate at Ingram Advocates.

It is recommended that the Minister approve this appointment.
