A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

2. The development hereby approved shall be carried out entirely in accordance with the plans and documents permitted under this permit. No variations shall be made without the prior written approval of the Minister for Planning and Environment

Comments on Case

When the application was submitted to the Department the letter accompanying the application advised that the proposal was to create a separate unit of accommodation attached to the existing house so that the owner of the property, who had recently been widowed could move into the new unit, and her daughter, who has 3 children, could then move into the existing property.  This is the letter referred to in Condition No. 1 of the permission. 

The new unit comprises a kitchen/diner, lounge, bedroom and bathroom.  The unit is an extension of the existing property to its north and the access to both units is a common entrance in the middle of the west facing elevation.  Each unit has an area of amenity space and parking that meets the Department’s criteria. 

However, it is considered that whilst the accommodation is acceptable for a two generation home (which is in line with the ‘homes for life’ requirements for new homes), as entirely separate accommodation it would be a cramped form of development resulting in an unsatisfactory overdevelopment of the site. 

Furthermore, it is the Department’s view that the formation of two separate units would result in a poor relationship between the two units and would be an example of bad planning and not what the Minister is aiming to achieve, which is a betterment in the standards of all types of accommodation.
