Transport and Technical Services - Capital Budget Transfer.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the request of the Minister for Transport and Technical Services (MD-T-2007-0060) to close the capital Head of Expenditure for Foul Sewers Extensions (reference C0452) and transfer the unspent balance of £329,172 to the Waste - Minor Capital Head of Expenditure.

Reason(s) for decision:

In compliance with Financial Direction 3.6 and as detailed in the attached report of the Finance Director, Transport & Technical Services.

Action required:

Treasury to effect the budget transfer.

TRANSFER BETWEEN CAPITAL HEADS OF EXPENDITURE

Purpose of the Report

The purpose of this report is to seek the Minister for Transport and Technical Services approval to a budget transfer from Capital Vote C0452 Foul Sewer Extensions to C2681 Waste - Minor Capital.

Background

Finance Direction No.3.6 ‘Variations to Heads of Expenditure’ sets out the procedures for the transfers between capital heads of expenditure and states that transfers of capital in excess of £100,000 require the approval of the Minister for Treasury and Resources and the relevant Minister party to the transfer.

Discussion

The Minister may recall that as part of the 2006 Capital Programme the Department’s capital allocation for Foul Sewer Reconstructions and Extensions reduced from £3 million to £2 million, this budget reduction resulted in there being no provision for foul sewer extensions. Currently an unspent balance of £329,172 remains on Capital Vote C0452 Foul Sewer Extensions.

The TTS Capital Programme Board is requesting that this Capital Vote C0452 is closed and the unspent balance of £329,172 is transferred to C2681 Waste - Minor Capital to fund essential equipment and maintenance expenditure within the Waste Directorate.

Recommendations

The Minister is recommended:

· to approve the closure of Capital Vote C0452 Foul Sewer Extensions with the unspent balance being transferred to C2681 Waste Minor Capital.

· to request that the Minister for the Treasury and Resources Department approves the budget transfer as detailed in the body of this report.

To ensure compliance with Finance Direction 3.6.

Action Required

For the Finance Director to request the Minister for the Treasury and Resources Department to approve the capital transfer referred to in this report.
