Proposed sale of land at York Lane to the Parish of St. Helier.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

1. agreed the proposal to sell the land to the Parish of St Helier for the sum of £10.00, subject to the Parish of St Helier meeting the Public’s reasonable legal fees 

2. agreed to request that the Treasury & Resources Minister agree to the transaction under Standing Order 168(2)(a) and that following notification to the States in accordance with Standing Order 168(3) to authorise the Greffier and Attorney General to sign the necessary contracts on behalf of the Public.

REPORT FOR HOUSING MINISTER 

SALE OF LAND AT YORK LANE TO THE PARISH OF ST HELIER 

The Public of the Island own York Lane which runs between Old Street, St Helier in between the social housing development at Hue Court and the Post Horn Public House.   

Old Street is a road owned by the Parish of St Helier. 

The area where Old Street and York Lane meet has been a problematic area for both the Parish of St Helier and the Housing Department for some time and has fallen into use as a de facto refuse collection area for local businesses and some passing fly tipping.  There are also ongoing issues with the management of illegal parkers using the turning area at the bottom of Old Street.   Both issues impact on residents of Hue Court. 

The Parish of St Helier would like to address this and as part of its ongoing programme of regenerating areas of the town would like to create an open amenity space in the area which it is hoped will be used by residents and town workers alike.  This would include the removal of the refuse bins and the cessation of parking in the area.  To facilitate this the Parish needs to acquire a small area (1,011 sqft) of York Lane from the Public. 

There is undoubted social benefit in regenerating this area and it is proposed that because of that benefit the proposed transfer of land should be for nominal value only.  Advice has been sought on the matter from Officers of Property Holdings and the Law Officers’ Department which has led to agreement on the terms of the proposed transaction such as are necessary to protect the Public.  These are set out in the Projet (P.06/2008) prepared by the Parish of St Helier for the Parish Assembly held on 25th June 2008 at which the Assembly agreed to the proposals. 

A copy of the Projet is attached hereto.  

Recommendation

 

That the Minister;- 

1. approve the proposal to sell the land with an area of 1,011 sqft and depicted in the attached Projet P.06/2008, to the Parish of St Helier for the sum of £10.00, subject to the Parish of St Helier meeting the Public’s reasonable legal fees 

2. request that the Treasury & Resources Minister agree to the transaction under Standing Order 168(2)(a) and that following notification to the States in accordance with Standing Order 168(3) to authorise the Greffier and Attorney General to sign the necessary contracts on behalf of the Public.
