Road Traffic (St. Clement) (Jersey) Order 1987: Amendment: Law drafting request

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision: To amend the Road Traffic (St Clement) (Jersey) Order 1987 to formalise a one way system, introduce new prohibition of waiting restrictions, amend Parking Disc Zone restrictions and confirm a temporary amendment.

ROAD TRAFFIC (ST CLEMENT)(JERSEY) ORDER 1987

 

 

Purpose of the Report

 

To amend the Road Traffic (St Clement) (Jersey) Order 1987 by amending Schedules 1 to 4 in the Order.

 

 

Background

 

Amendment to Schedule 1 “One-Way Traffic Routes” summarised below

 

After a trial period the Parish wishes to formalise a one way system which manages traffic flow and residents’ parking more effectively.

 

Amendment to Schedule 2 “Prohibition of Waiting” summarised below

 

The Connétable of St Clement has requested that in the interest of road safety waiting is prohibited on a section of La Grande Route de la Cote.

 

 Amendments to Schedule 3 “Parking Discs – 2hr zone”

 

The Connétable has requested an amendment to the restrictions for the Parking Disc Zone on La Greve d’Azette.

 

Amendment to Schedule 4 “Roads closed to through traffic”.

 

In December 2011 a temporary amendment to the Road Traffic (St Clement) (Jersey) Order 1987 was made using powers granted under Article 68 of the Road Traffic Law. The Amendment is temporary and after 12 months must be formalised into the Parish Road Traffic Order if it is to become permanent.  Parish officials are now satisfied that the temporary amendment is appropriate and therefore wish the change to be included in the Parish Road Traffic Order.

 

 

Discussion

 

Amendment to Schedule 1 “One Way Roads” summarised below

 

Georgetown Park Estate is to be made one way in an anticlockwise direction. The reference to Georgetown Park Estate is to be removed from Schedule 4 “Roads closed to through Traffic”

 

Amendment to Schedule 2 “Prohibition of Waiting” summarised below

 

Extend ‘Prohibition of Waiting’ on La Grande Route de la Cote in a westerly direction from where the current restriction ends outside Sydney Crill Park for 50 yards both sides. This has been requested after reports of motorists parking their cars close to this entrance making it difficult, and in some cases dangerous, for residents leaving the estate.

 

Amendments to Schedule 3 “Parking Discs – 2hr zone” summarised below

 

 Outside the Victor Hugo Apartments on Greve d’Azette to prevent the current restriction being abused by motorists. 

Insert a new section sub paragraph to Part 4 of the Schedule: when a vehicle is left as aforesaid no person shall – (d) permit the vehicles to park in any part of that road within one hour of its departure.

 

Amendment to Schedule 4 “Roads Closed to Through Traffic” summarised below

 

Le Squez Road (between its junction with the entrance to Les Burons and its junction with School Road)

This road will be closed to all traffic except for pedal cycles, emergency vehicles and buses travelling in a southbound direction.

The current entry for Georgetown Park Estate deleted from this schedule as it is no longer relevant.

 

 

Recommendation

 

The Minister is requested to approve the amendments.
