EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016: Fees: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister requested the Law Draftsman to prepare an Order to prescribe the fees and charges payable for authorization, registration, inspections, tests or official examination required by the EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016.

Reason(s) for Decision: 

The States approved the EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016 on the 12 April 2016. The Minister may, by Order, prescribe new fees and charges (Regulation 38) in accordance with the ‘user pays’ principle.

Purpose of the Report

 

To make an Order requiring payment of fees and charges, in accordance with Regulation 38 of EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016.

 

Background

 

The States approved EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016 on 12 April 2016.

 

The Regulations implement Council Directive 2006/88/EC on animal health requirements for aquaculture animals and products of those animals, and on the prevention and control of certain diseases in aquatic animals; and Commission Regulation (EC) No 1251/2008 of 12 December 2008 implementing Council Directive 2006/88/EC as regards conditions and certification requirements for the placing on the market and the import into the Community of aquaculture animals and products thereof and laying down a list of vector species.

 

Power to introduce fees by Order for an official function carried out in accordance with these regulations is provided, consistent with User Pays policy.

 

Discussion

 

Regulation 38 gives the Minister power, by Order, to prescribe fees in relation to certificates, approvals, authorizations, registrations, inspections, tests and official examinations. The proposed fee is based on estimated time for necessary consideration and administration of applications for authorisations or registration; for carrying out inspections and recovery of cost for any test or official examination carried out.

 

Conclusion

 

Introduction by Order of fees and costs, accords with User Pays policy and Regulation 38.  

 

Recommendation

 

The Minister is recommended to make an Order to introduce the fees.
