Police: Re-Location: Budget Consolidation

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The consolidation of two existing Capital Heads of Expenditure for the Police Relocation project.

Decision(s): 

The Minister for Treasury and Resources approved the -

  • consolidation of two existing Capital Heads of Expenditure titled ‘Police Relocation-Tranche 4’ and ‘Police Relocation Phase 1’ in order to improve the administration and reporting of the project;
  • transfer of £17.8 million approved budget and associated current spend, from the Police Relocation Phase 1 Capital Head of Expenditure to the Police Relocation-Tranche 4 Capital Head of Expenditure;
  • renaming of the Capital Head of Expenditure from Police Relocation-Tranche 4 to Police Relocation.

Reason(s) for Decision:  

Article 2(6) of the Public Finances (Transitional Arrangements) (Jersey) Order 2011 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure. 

 

The Police Relocation is being run as one project (with the funding in tranches). In order to improve administration and reporting the budgets should be consolidated into one Capital Head of Expenditure.

Resource Implications:  

The Police Relocation Phase 1 Capital Head of Expenditure to decrease by £17.8 million and the renamed Police Relocation Capital Head of Expenditure to increase by an identical amount. This decision does not increase the total amount of expenditure approved by the States.

Action required:  

Business Manager to notify the Financial Performance Reporting Manager and the Finance Manager, Property Holdings that this decision has been approved

Police Relocation Budget Consolidation

 

  1. Purpose of Report

 

To enable the Treasury and Resources Minister to approve the consolidation of two existing Capital Heads of Expenditure entitled ‘Police Relocation-Tranche 4’ and ‘Police Relocation Phase 1’ into a single Capital Head of Expenditure entitled ‘Police Relocation ’. To also enable the Minister to approve the transfer of funds to this head of expenditure as set out in this report. The purpose of this consolidation is to facilitate better administration and financial management of this capital project.

 

  1. Background

 

The Police Relocation Capital Head of expenditures were set up with the original intention for the Police Relocation to be a phased set of works utilising different Heads of Expenditure. However it has been recognised that the project works are to be completed as one phase. Therefore the intention is to merge the Capital Head of Expenditure phases under one Capital Head of Expenditure.

 

  1. Police Relocation Budget Consolidation

 

The Police Relocation Capital Head of Expenditures requires that the budget of £16,000,000 will be transferred from ‘Police Relocation Phase 1’ Capital Head of Expenditure to the renamed ‘Police Relocation’ Capital Head of Expenditure. This does not change the use of the funds voted by the States for the construction of a new Police Headquarters.

 

A further allocation of £1 million for the Police relocation is due in 2014, subject to approval in the budget, and this sum will also be added to the single Head of Expenditure to provide a consolidated budget sum for the project.

 

4.  Recommendation

 

The Minister for Treasury and Resources is recommended to approve the -

  • consolidation of two existing Capital Heads of Expenditure titled ‘Police Relocation-Tranche 4’ and ‘Police Relocation Phase 1’ in order to improve the administration and reporting of the project.
  • transfer of £16,000,000 from the Police Relocation Phase 1 Capital Head of Expenditure to the Police Relocation-Tranche 4 Capital Head of Expenditure
  • renaming of the Capital Head of Expenditure from Police Relocation-Tranche 4 to Police Relocation.
