Temporary Release of Prisoners at Christmas 2009: Approval to Extend

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister gave approval for periods of temporary release to be extended at Christmas, but decided that it would not apply to temporary release outside Jersey.

Reason(s) for Decision:

The extended periods of absence will permit prisoners, who qualify, to spend more quality time with their family or friends during the holiday period when they are likely to have time off work or school.

TEMPORARY RELEASE AT CHRISTMAS (2009) 

1. The purpose of the Report 

  1. The report seeks the Minister’s approval to:

 

i) Extend the period of temporary release permitted at Christmas from 2 days to 6 days. 

ii) Extend this request to cover prisoners requesting temporary release to the UK and Ireland without the need to bring each request to the Minister; 

iii) Approve up to 2 days in Jersey, temporary release for any prisoner who currently has short duration community visits of (3hrs) this to be taken at an approved address. 

2. The Issue 

  1. The Minister approved the extension of time for temporary release at Christmas in 2007and 2008 for the same duration as described above. The slightly longer period of temporary release allows prisoners to spend slightly longer with their families or significant others at a time when they are less likely to be at work or school. It is also quality time together at what is traditionally a family occasion (which is particularly important for those with children).

 

2.2 To give the Temporary Release Panel authority to permit those who have demonstrated a responsible attitude and have been risk assessed by the panel as suitable for Community Visits of 3hrs, the opportunity to spend up to 2 days with their families or significant others. 

3. Recommendation 

  1. The proposal is that eligible prisoners may apply for up to 6 days temporary release at Christmas (including those requesting to take the period of absence in the UK); and those on Community Visits be permitted home leave of up to 2 days.

 

3.2 The proposal is supported by the Temporary Release Panel. 

3.3 The Minister is asked to approve this extension to temporary release.
