A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

       The Minister approved, as recommended by Jersey Property Holdings, the construction plans for the redevelopment of Field 91A, Belle Vue, La Route des Quennevais, St Brelade in accordance with the requirements of Standing Order 168(1)(d) as set out in the accompanying report.

 

Reason(s) for Decision:

 

       The Minister approved under Standing Order 168(a)(d) the above land transaction.

 

Resource Implications:

 

       The project is to be funded from the Housing Department’s capital budget.

 

Action required:

 

       The Director of Jersey Property Holdings to inform the Housing Department of the approval in order that the project may proceed.

REPORT TO THE HOUSING MINISTER

TO APPROVE THE SCHEME TO BUILD 35 No

11/2 BEDROOM FLATS ON 91A BELLE VUE, ST BRELADE

 

 

 

Background

 

The Minister will recall that on the 17th August 2012, he approved the feasibility report containing the proposed scheme to develop 35 No 11/2 bedroom flats on field 91A St Brelade, as set out in MD-H-2012-0078.

 

The Design team lead by the architects from Property Holdings submitted a modified planning application and planning approval has now been granted to build 35 No 11/2 bedroom flats on field 91A Belle Vue St Brelade permit number P/2009/2419 refers.  A copy of the permit and drawings numbered10255:47 Rev B; 10255:48 Rev A; 10255:49 Rev A; 10255:P50 Rev A; 10255:51 Rev A; 10255:52 Rev A and 10255:53 Rev B are attached hereto for the Minister to approve.

 

Recommendation

 

That the Minister:

 

  • Approve the scheme as set out in permit number P/2009/2419 dated 16th November 2012 and drawings numbered 10255:47 Rev B; 10255:48 Rev A; 10255:49 Rev A; 10255:P50 Rev A; 10255:51 Rev A; 10255:52 Rev A and 10255:53 Rev B
  • Request that the Minister for Treasury & Resources accept his recommendations in accordance with States Standing Order 168(2).
