A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister requested the Law Draftsman to prepare an Order to prescribe the fees and charges payable for certificates, approvals, inspections, tests, examinations and other activities required by the EU Legislation (Veterinary and Zootechnical Checks-Trade with Member States) (Jersey) Regulations 2016

Reason(s) for Decision: 

The States approved the EU Legislation (Veterinary and Zootechnical Checks – Trade with Member States) (Jersey) Regulations 2016 on the 22 March 2016. The Minister may, by Order, prescribe new fees and charges (Regulation 25 & 26) in accordance with the ‘user pays’ principle.

Purpose of the Report

 

To make an Order requiring payment of fees and charges, in accordance with Regulations 25 and 26.

 

Background

 

The States approved the EU Legislation (Veterinary and Zootechnical Checks – Trade with Member States) (Jersey) Regulations 2016 on the 22 March 2016. These Regulations implement Council Directive 90/425 concerning veterinary and zootechnical checks applicable in intra-Community trade in live animals and certain animal products with a view to the completion of the internal market.

 

Power to introduce fees by Order for an official function carried out in accordance with these regulations is provided, consistent with User Pays policy.

 

Discussion

 

  1. Regulation 25 confers a power for the Minister to prescribe fees for the purposes of these Regulations. The fees may be set so as to recover the full cost of an official veterinarian (OV)* or inspector’s time for examination, inspections, tests and other activities.  

Regulation 5 Requirements for export. A consignment must be accompanied, throughout its journey, with the necessary health certification and other documents required as evidence that it satisfies the health requirements applicable in its case. The proposed fee is based on estimated time for necessary consideration and administration of health certificates. Any official examination will be carried out by an OV, any payment will be a private matter between the consignor and the OV.

 

  1. Regulation 26 A consignor in charge of animals or animal products is liable for any reasonable expenses arising out of or in connection for any inspections, tests, examinations and other activities carried out by an OV or inspector in connection with the exercise of any power by these Regulations.

Regulation 13 Official veterinarian’s powers in respect of illegal consignments: If an OV knows or suspects the presence of disease the OV may serve a notice and require the person that appears to be in charge of the animals or animal products to certain things and the person is liable for any reasonable expenses.

 

*An OV can be either a private veterinarian surgeon appointed by the Minister or the States Veterinary Officer.

 

Conclusion

Introduction by Order of fees and charges payable, accords with User Pays policy and Regulation 25 and 26.  

 

Recommendation

The Minister is recommended to make an Order to introduce the fees.
