Regulation of Care Law – law drafting time lines, project plan and stakeholder group terms of reference

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

INTRODUCTION 

Openness is a central goal in legislation drafting and consultation is an established part of this process.  Through consultation with stakeholders, law drafters and decision makers can gather expert and empirical views as well as opinions on the impacts of those who will be affected by the proposed regulation.  This should improve the quality and substance of the legislation.  By allowing the expression of different opinions through stakeholder involvement the resulting legislation is likely to be more readily accepted and consequently more effective.  This in turn will contribute to a higher level of compliance. 

One outcome of the first Stakeholder Consultation on the proposed Regulation of Care (Jersey) Law 200- was support for a stakeholder group to maintain dialogue throughout the law drafting period.  This was welcomed and endorsed by the Minister for Health and Social Services. 

The Stakeholder Consultation Group will operate as part of a broader consultation process that will occur as drafting progresses.  It is important to note that the Stakeholder Consultation group complements the department’s role in drafting new legislation, but does not replace it.  The group is not a decision making body, however the Minister will consider all recommendations, input and feedback when making final decisions relating to the content of the proposed Law. 
 

PURPOSE 

The group exists to:  

·     Provide a two way channel of communication between the Health and Social Services department and representatives of those who may be affected by the proposed legislation

 

·     Give an opportunity to question the department about the proposed provisions in the legislation

 

·     Enable stakeholders an opportunity to comment on and influence the content of the proposed legislation

 

·     Propose appropriate members for and facilitate the setting up of sub groups to address and comment on specific areas of specialist care

 

·     To participate in the setting of standards

 
 
 
 
 
 

MEMBERSHIP 

The membership of the group will reflect key interested parties and will include political, independent sector, public sector, service user and professional representation. 

The group will be chaired by the Head of Health Protection or nominated alternate.  The Assistant Director of Corporate Planning and Performance Management H&SS and the Registration and Inspection Manager, (who together with the Head of Health Protection form the Primary Steering Group) will attend group meetings to feed back progress and receive comments from group members. 

A maximum of eight appointed members will be invited to form the group including representation from the following:

·     States Members

·     Health Social Security and Housing Scrutiny Panel

·     H&SS Senior Management Team

·     FN&HC

·     Jersey Care Federation

·     Primary Care Body

·     Employment and Social Security Department

·     Jersey Carers Association

 

A representative organisation may identify an alternate who will be expected to attend meetings if the primary member cannot attend.  A minimum of five members should be present for meetings to be quorate including the Chair or nominated alternate, and at least three members of the appointed members. 
 

MEETINGS 

The group will meet quarterly as far as possible at times convenient to stakeholders. Administrative support for the group will be provided by Health Protection Services. An agenda will be sent out seven days before the meeting and minutes of the meeting will record the issues raised, any outcomes and recommendations. 
 

SUB-GROUPS 

Sub groups will be formed to assist the Stakeholder Consultation Group where specialist advice and expertise is required.  The terms of reference, number of members and constitution of the sub groups will be advised by the Stakeholder Consultation, with the final decision lying with the Head of Health Protection.  
 
 
 
 
 

ROLE OF SCRUTINY 

The invitation for representation from the Health Social Security and Housing Scrutiny Panel on the Stakeholder Group is not intended to replace the ordinary function of Scrutiny.  Rather this is to enable Scrutiny to participate in the ongoing consultation process before and during Law Drafting.   

It is envisaged that the first proposed draft of the Law will be formally reviewed by Scrutiny in the fourth quarter of 2011 as part of the second stakeholder consultation.  Scrutiny will have a further opportunity to review formally any resulting changes from the consultation in the second quarter of 2012, prior to lodging the Law in the States. 
 

TERM OF STAKEHOLDER GROUP 

The Stakeholder Consultation Group will continue throughout the duration of the Law drafting process and until the Law comes into force.  The terms of reference will be reviewed by the Primary Steering Group annually.
