Appointed Day Act for Limited Partnerships (Amendment) (Jersey) Law 2009

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Approval of the Appointed Day Act for the Limited Partnerships (Amendment) (Jersey) Law 2009.

 

Decision(s):

 

The Minister approved the Limited Partnerships (Amendment) (Jersey) Law 2009: Appointed Day Act and asked that it be lodged ‘au Greffe’ forthwith and with a view to securing a date for debate that would facilitate the coming into force of the Law on 1st March 2009.

 

Reason(s) for Decision:

 

The Appointed Day Act is required to bring into force the Amending Law, which contains miscellaneous amendments to the Limited Partnerships (Jersey) Law 1994.  The Amending Law was adopted by the States on 15th July 2008, sanctioned by the Privy Council on 10th December 2008 and registered in the Royal Court on 2nd January 2009.

 

Resource Implications:

 

There are no measurable financial or manpower costs for the States.

 

Action required:

 

The Appointed Day Act to be lodged au Greffe for debate by the States at the earliest opportunity.

1.  ISSUE AND RECOMMENDATION

 1.1.      The Limited Partnerships (Amendment) (Jersey) Law 2009 (“the Amending Law”) contains miscellaneous amendments to the Limited Partnerships (Jersey) Law 1994, including new provisions ensuring that a limited partnership has the occupier's authorization to use premises as its registered office and enabling the general partners to request a limited partnership's deregistration.

1.2.      The Amending Law was adopted by the States on 15th July 2008, sanctioned by the Privy Council on 10th December 2008 and registered in the Royal Court on 2nd January 2009 and now requires an Appointed Day Act to be brought into force.  The draft Appointed Day Act brings the Amending Law into force on 1st March 2009.

1.3.      It is recommended that the Minister approves the Appointed Day Act and that it be lodged au Greffe for debate by the States at the earliest opportunity.
