A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

JUNCTION WITH LITTLE GREEN STREET AND GRENVILLE STREET

Purpose of the Report

The installation of a proposed 2 Stage Zebra Crossing on Green Street at the Junction with Little Green Street and Grenville Street.

Background

During the States of Jersey debate on the Sustainable Transport Policy in 2010, the Connétable of St Helier successfully brought an amendment to that policy instructing TTSd to investigate pedestrian facility improvements at five locations in St Helier. The junction of Grenville Street and Green Street was one of those locations. Subsequently the Department has studied traffic and pedestrian flows in the area and determined that a two stage zebra crossing is an appropriate facility to install for pedestrians crossing Green Street, just south of the junction with Grenville Street.

Discussion

The Department has carried out a survey of pedestrian and vehicle movements on Green Street at the junction of Grenville Street and determined that a two stage zebra crossing utilising a central traffic splitter island would be appropriate. However, the current footpath widths and visibility site lines are below the widths and standards required for a zebra crossing. As part of the work to install a two stage zebra crossing with belisha beacons, the footpaths in the immediate area will have to be widened. Of note is the footpath on the western side outside “Bohemia” which will need to be substantially widened to ensure pedestrians establishing precedent over drivers can be clearly seen by drivers approaching from Green Street roundabout.

The central island will need to be removed and re-built to accommodate the traffic management required, as well as needing to be re-modelled to accommodate the widened footways. The re-modelled island will also result in a slightly improved turn from Little Green Street into Grenville Street for buses. It is proposed to re-build the central island using granite kerbs and tarmac to match the existing kerbs and footpaths in the area.

Belisha beacons and an additional street light are proposed to ensure that the crossings are visible to drivers and pedestrians are clearly visible to drivers. A drawing of the proposed zebra crossing and associated works is attached at appendix A.

A public consultation was held earlier in the year. The Connetable of St Helier has also been consulted. In the Connétables consultation response he requested a zebra crossing be placed on the northern leg from the centre Island. A zebra crossing on this leg is not considered to be appropriate for the following reasons:

Drivers of vehicles turning from Little Green Street into Grenville Street are likely to be concentrating on identifying gaps in the traffic approaching from Green Street, and fail to give way to pedestrians trying to establish precedent. Pedestrians using the crossing without establishing precedent would be at risk of collision with such drivers.
Vehicles entering Grenville Street from Little Green Street would need to stop on the zebra crossing to give way to vehicles approaching from Green Street Roundabout.
Visibility for pedestrians establishing precedent over cars on Little Green Street would be substandard.

Under Article 69 of the Road Traffic (Jersey) Law 1956, the Minister for Transport and Technical Services may, after consultation with the Connétable of the Parish in which the road is situated, establish on any road such crossings for pedestrians as the Minister considers necessary.

Recommendation

The Minister is recommended to approve the installation of a 2 stage zebra crossing and associated works on Green Street at the junction with Grenville Street, but not to place a zebra crossing from the northern leg of the centre island.
