Transfer of Visioning Funds to Property Holdings Department.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Transfer of Visioning Funds to Property Holdings Department

Decision(s):

The Chief Minister agreed the transfer of the £1,176,500 from the CMD Visioning Fund to the Property Holdings Department, this being the unspent portion of the Funds originally set aside for the Property Holdings transformation project.

Reason(s) for Decision:

The States agreed in 2005 that a sum of £1.5 million would be allocated from the Visioning Fund to support the development of the Property Holdings Department and since then a total of £323,500 has been used. To date each call on the Fund has required a ministerial decision from both the Chief Minister and the Minister for Treasury and Resources. The transfer of the balance to the Property Holdings Department will save further ministerial decisions, and provide that the governance of these funds is passed to the Accounting Officer of Property Holdings.

Purpose of Report

To obtain approval to transfer a capital budget of £1,176,500 from the Chief Minister’s Department to the Treasury and Resources Department relating to the Visioning Funds allocated for the development of the Property Holdings Department

Background

In June 2005 the States agreed to the creation of a new department to be responsible for the administration of all States Property. The Department was tasked with making £1.5m of recurring efficiency savings and £4m of capital receipts.

At its meeting of 19th April 2006 the Corporate Management Board approved an implementation plan of Property Holdings and determined that funds held in the £9m Visioning Budget would be used for Property Holdings as below.

The Department has spent £323,500 of these funds to date.

Given that the spending decisions regarding this expenditure are taken by the T&R Department, it is entirely appropriate that the budget should be transferred to that Department.

Recommendation

That the Minister agrees to transfer £1,176,500 from the CMD Visioning Fund to the Property Holdings Department to be used for the development of the Department and target efficiency savings of £1.5m per annum.
