Authority to Enter Premises - Health Protection Officers.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TITLE Authority to Enter Premises – Officers of Health Protection

Background

Under Article 10 of the Loi (1934) Sur la Sante Publique (Public Health Law 1934) it was a requirement of the previous Health and Social Services Committees to name one or more Sanitary Officers (now referred to as Environmental Health Officers) “whose duties shall be determined by the special regulations adopted to this effect by the Committee”.

It was also recognised for these staff (now of the Health Protection Unit) to possess a document authorising them to enter premises in pursuance of their duties under the various public health legislation, with the proviso that those officers titled Health Protection Technicians were only authorised to enter premises under associated public health legislation as the Public Health Law 1934 expressly precluded them from having statutory power of entry.

In all cases the document was to be supported by the Health and Social Services security card as a means of proving identity and engagement by the then Committee.

  6. Article 3 - Burials and Exhumation (Jersey) Law 2004
  7. Article 3 - Public Health (Vessels and Aircraft) (Jersey) Law 1950
  8. Article 1(F) – Restriction on Smoking (Jersey) Law 1973

Issues

Since the last set of authorizations issued by the former Health and Social Services Committee the States of Jersey have enacted further legislation requiring the authorization of staff to undertake certain roles on behalf of the Minister for Health, namely the Restriction on Smoking (Jersey) Law 1973 as amended including Regulations thereunder.

In addition the Health Protection Unit has also recently engaged new members of staff to replace those who have either left the service through retirement, returned to the UK, or are currently on Maternity Leave. The new members of staff are;

Andrew Pritchard, an Environmental Health Officer and Team Leader – Community Health, Kirsty Walker, Environmental Health Officer,

David Phillips, Locum Environmental Health Officer.
