Draft Control of Housing and Work (Jersey) Law 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Draft Control of Housing and Work (Jersey) Law 201-.

Decision(s):  The Chief Minister, acting in accordance with indications of the Council of Ministers, and as the responsible Minister, approved the draft Control of Housing and Work (Jersey) Law 201- and accompanying Report and has asked that it be lodged au Greffe on 15th March for debate on 7th June 2011. The Minister also signed the Statement of Compatibility confirming that the provisions of the draft law were compatible with the European Convention on Human Rights.

Reason(s) for Decision: P25/2005: Migration: Monitoring and Regulation, was debated and adopted by the States in 2005. P25/2005 put forward a number of proposals with a view to revising the current controls over housing and work provided by the Housing (Jersey) Law 1949 and the Regulation of Undertakings and Development (Jersey) Law 1973.  Following extensive consultation, this Control of Housing and Work (Jersey) Law, 201- (the “Law”) is proposed.

Resource Implications: The overall net effect of this Law is a projected revenue saving of £33,000, which will mean that the projected gross annual cost of administering these controls is £781,000. A capital investment of £565,000 is also required, mainly for the new systems, which could have an expected life of 8 – 10 years. (The existing systems of the Population Office are already over 12 years old, and in need of replacement irrespective of whether this Law is approved). These capital costs are already provided for in the Information Services budget.

Action required: To ask the Greffier of the States to lodge the Report and Law ‘au Greffe’ on 15th March 2011 for debate on 7th June 2011.
