Jersey Police Complaints Authority: Appointment of Chairman and 2 Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Jersey Police Complaints Authority – appointment of Chairman and reappointment of 2 members.

Decision(s): The Minister decided to propose the appointment of Mrs Deborah Prosser as Chairman of the Jersey Police Complaints Authority (JPCA) for a period of three years with effect from the 1 January 2013; and to reappoint Mr Bruce Ridley and Ms Jane Martin as members of the JPCA for a further period of 3 years from 1 January 2013.  The Minister approved a report and proposition recommending the appointments.

Reason(s) for Decision: Mr Tom Slattery has decided to retire as Chairman of the JPCA with effect from 31 December 2012.  Mrs Prosser has been a member of the JPCA since January 2008 and her appointment as Chairman, without advertisement, has been approved by the Appointments Commission.  Mr Ridley and Mrs Prosser’s terms of office as members of the JPCA are due to expire on 31 December 2012.  They have expressed a wish to remain in office for a further 3 years.

Resource Implications:

There are no additional financial or manpower implications arising from this proposition.

Action required:

The Executive Officer, Home Affairs, to request the Greffier of the States to arrange for the attached Proposition to be lodged ‘au Greffe’ for consideration by the States in due course.

Jersey Police Complaints Authority: Appointment of Chairman and 2 Members

 

PROPOSITION

 

THE STATES are asked to decide whether they are of opinion

 

in accordance with Article 2 of, and the Schedule to, the Police (Complaints and Discipline) (Jersey) Law 1999 –

 

(a) to appoint Mrs Deborah Prosser as Chairman of the Jersey Police Complaints Authority for a period of three years, effective from 1 January 2013; and

 

(b) to re-appoint the following members of the Jersey Police Complaints Authority for a further period of three years, effective from 1 January 2013 –

 

  Mr Bruce Ridley

 

  Ms Jane Martin

REPORT

 

The 3 year tenure of office of Mr Tom Slattery as Chairman of the Police Complaints Authority will come to an end on 31 December 2012.  Mr Slattery does not wish to stand for a further term and will retire at the end of his period of office.  The Jersey Appointments Commission has approved the appointment of the current Deputy Chairman, Mrs Deborah Prosser, as Chairman, without advertisement due to the need to maintain continuity.  Mrs Prosser has been a member of the Police Complaints Authority since January 2008.

 

The appointment would be effective from 1 January 2013 for a period of three years.  

 

The Jersey Appointments Commission agreed to the appointment of Mrs Prosser directly to the Chairman’s role as four other members’ terms of office also expire on 31 December 2012 and only two members wish to be considered for a further three year term.  It was thought necessary to maintain some continuity and the two remaining members did not wish to be considered for the role of Chairman but fully support the appointment of Mrs Prosser to this role.  There is now a requirement to recruit three new members to the Authority from 1 January 2013.  A recruitment campaign will commence in autumn 2012.  Mr Ridley and Ms Martin have been members of the Police Complaints Authority since January 2010.  The Jersey Appointments Commission have not been involved in their re-appointment, as they have only served one term of office so can be re-appointed without competition.

 

The Minister recommends that Mrs Deborah Prosser be appointed to serve as Chairman of the Jersey Police Complaints Authority for a period of three years –

 

Mrs Deborah Prosser

 

Mrs Deborah Jane Prosser (née Nance, formerly Lang) was born in England and completed her education in Jersey, where she has lived for the last 35 years.  As a Jersey Advocate she was Managing Partner of the Jersey Law firm Bailhache Labesse for a number of years, as well as being Managing Director of Bailhache Labesse Trustees Ltd.

 

Mrs Prosser is a Commissioner of the Jersey Financial Services Commission and a member of the Youth Court Panel.  She holds a number of non-executive directorships.  Mrs Prosser was a member of the Education Audit Committee, latterly its Chairman, and for three years was a member of the Audit Commission.  She was the founder Chair of the Jersey Childcare Trust, a Governor of Haute Vallée School and a member of the Tourism Development Committee.  In her spare time Mrs Prosser enjoys various hobbies and travelling.

 

The Minister recommends that the following persons be appointed to serve on the Jersey Police Complaints Authority for a further period of three years –

 

Mr Bruce Laurence Ridley

 

Mr Ridley is an IT consultant having formerly been a Director with one of the largest information technology companies in the Island and previously held posts as Deputy Managing Director of another large IT company and as Operations and Information Services Manager for the States of Jersey.  He has also been a Committee Member for PADA (Parents Against Drug Abuse) and Treasurer for Jersey Cancer Bacup.  His leisure activities include golf, cycling and shooting.

 

Ms Jane Martin

 

Ms Martin qualified as a Jersey Advocate in 1995 and pursued a legal career until her retirement in December 2008, by which time she was the Managing Partner in a local legal firm.  She is currently Chief Executive of the Law Society of Jersey, a position she has held since September 2010.  She completed her Law Degree at Exeter University.  In addition, Ms Martin has been on the Board of Examiners for the Jersey professional law exams, a Panel Judge for Jersey Enterprise Awards and is an invited governor on the Board of Governors, Jersey College for Girls/JCG Preparatory School.  Ms Martin’s hobbies include reading and keeping fit.
