Jersey Police Complaints Authority - Appointment of Chairman and re-appointment of three members - withdrawal and revised Report and Proposition

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (16.09.2009) to request that P129/2009 - 'Jersey Police Complaints Authority Appointment of Chairman and re-appointment of three members' be withdrawn  and that a revised Report and Proposition be lodged 'au Greffe'.

Subject: Jersey Police Complaints Authority - appointment of Chairman and re-appointment of three members.  To request that P129/2009 be withdrawn and that the revised Report and Proposition be lodged ‘au Greffe’.

 

Decision(s): The Minister requested that P129/2009 be withdrawn; and approved the revised Report and Proposition which recommends to the States the appointment of the Chairman of the Police Complaints Authority for a period of three years from 1 January 2010 and the re-appointment of three members of the Authority for the same period.  The Minister requested that the revised Report and Proposition be lodged ‘au Greffe’ forthwith, with a view to securing a debate on the 6th October 2009.

 

Reason(s) for Decision: P129/2009 describes the Chairman as ‘resigning’ rather than standing down at the end of his period of office.  Accordingly, it is desirable that it should be withdrawn, and that a revised Report and Proposition should be lodged ‘au Greffe’.

 

The period of office of the Chairman of the Police Complaints Authority is due to expire on 31 December 2009.  Having contributed to the role for many years, the Chairman has taken the decision to stand down at this time.  Following an advertisement in the Jersey Evening Post, a new Chairman has been selected, subject to appointment by the States. 

 

Four other member’s terms of office also expire on the 31st December 2009. Three of the members wish to be considered for a further three year term and one member does not wish to be re-appointed.  As two of the existing members have been in office for more than two terms, and in accordance with the Appointments Committee Code of Practice must be considered alongside other applicants in open competition, the positions were advertised in the Jersey Evening Post.  No applications were received. 

 

The Appointments Commission representative has given approval to an extension of the terms of office for the three existing members, without the need to undergo a further interview as it has proved difficult to attract other candidates with the requisite knowledge and experience.

Action required: The Executive Officer, Home Affairs, to request the Greffier of the States to withdraw P129/2009, and to request that the attached report and proposition be lodged ‘au Greffe’ forthwith, with a view to securing a debate on the 6th October 2009.

PROPOSITION

 

THE STATES are asked to decide whether they are of opinion –

 

in accordance with Article 2 of, and the Schedule to, the Police (Complaints and Discipline) (Jersey) Law 1999 –

 

(a) to appoint the following as the Chairman  of the Jersey Police Complaints Authority for a period of three years, effective from 1 January 2010 -

 

               Mr Thomas Slattery

 

(b) to re-appoint the following members of the Jersey Police Complaints Authority for a further period of three years, effective from 1 January 2010 –

 

               Mr Anthony Beaumont

 

               Mr Andrew Cornish

 

               Mr Stephen Luce

REPORT

 

The 3 year tenure of office of Mr Leslie May as Chairman of the Police Complaints Authority will come to an end on the 31st December 2009.  Mr May was hugely influential in the setting up of the initial scheme, and has been the Chairman for 3 terms of three years.  He has now decided to step down at the end of this period of office.  The position was advertised in the Jersey Evening Post, and following an interview by a panel comprising the Chief Officer for Home Affairs, a Human Resources Manager for Home Affairs, and a representative of the Jersey Appointments Commission, Mr T Slattery was found to be an acceptable candidate.  Mr Slattery is currently the Deputy Chairman of the Police Complaints Authority and has served the Authority since 2005.

 

The appointment would be effective from 1 January 2010 for a period of three years.

Mr Thomas Slattery

 

Thomas Lindsay Slattery C.A., graduated from Edinburgh University and subsequently qualified as a chartered accountant.  He has retired as Managing Director of Hill Samuel Jersey and Lloyds TSB Offshore Private Banking Companies.  Prior to coming to Jersey in 1989, Mr. Slattery held a number of senior positions with the TSB Banking group in Scotland.  Mr. Slattery is presently the Chair of the board of the Jersey Advisory and Conciliation Service.  His leisure activities include reading and travelling.

           

The Minister recommends that the following persons be appointed to serve on the Jersey Police Complaints Authority for a further period of three years –

 

Mr Anthony Beaumont

 

Mr Beaumont was employed as a Senior Engineer with the Public Services Department from 1974 to 1998.  Following his apprenticeship as a mechanical engineer he served with HM Forces with the REME.  He then worked for various major civil engineering contractors in the UK before coming to Jersey to join the Public Services Department. Mr Beaumont has been a member of the Police Complaints Authority since January 2001.

 

 

 

 

Mr Andrew Cornish

 

Mr Cornish is Practicing Optometrist and director of an Opticians in St Helier.  He was born in Bedfordshire and educated at the City University, London. He has been a member of the Police Complaints Authority since January 2004. 

 

Mr Stephen Luce

 

Mr Luce was born in Jersey and educated at Victoria College and the Royal Agricultural College, Cirencester.  From 1996 to 2003 he served on the Youth Panel and was a member of the Review Panel for the dairy industry (1992) and on the Jersey Farmers Union during the 1990s.  He has also been a Roads Inspector and on various parish committees in St Martin, as well as an organist at St Martin’s Parish Church.  Mr Luce has been a member of the Authority since 1 January 2007.

 

I therefore recommend that the above appointments be made, and would like to formally record my gratitude to Mr May, upon his retirement as Chairman, for all that he has contributed over the years to the Police Complaints Authority.

 

There are no additional financial or manpower implications arising from this proposition.
