Motor Traffic (Cabs - Fares and Charges) (Jersey) Order 2017: Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister agreed to prescribe the increases to taxi-cab tariffs as set out in the attached report, and approved instructions to be sent to the Principal Legislative Drafter to amend the Motor Traffic (Cabs-Fares and Charges) (Jersey) Order 2017.

 

Reason(s) for Decision: To amend the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2017, to allow an increase in controlled taxi-cab fares.

MOTOR TRAFFIC (CABS - FARES AND CHARGES) (JERSEY) ORDER 2017

 

TAXI-CAB FARE INCREASE 2019

 

 

Purpose of the Report

 

To seek the support of the Minister for Infrastructure, in accordance with his powers under Articles 38(1), and (2)(a) of the Motor Traffic (Jersey) Law 1935 which provides that:

 

“(1) It is the duty of the Minister to prescribe by Order such matters as it is necessary or convenient to prescribe to ensure that, insofar as it is practicable to do so, there is an adequate, efficient and reasonably priced cab service available throughout Jersey at all times.

 

(2) The Minister may, in particular, prescribe –

(a) the fares and charges payable for the hire of cabs;”

 

to amend the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2017.

 

 

Background

 

In line with the ongoing reform of the Taxi-Cab industry to continue to review annually the scale of fares and charges and in consultation with the Minister and Industry bodies agree an appropriate annual increase.

 

Following correspondence from the Jersey Taxi Drivers Association (JTDA) requesting the fares be increased in line with the March Taxi RPI, options for the increase based on the current fare structure were presented to the Minister.

 

 

Discussion

 

The Head Statistician provided the latest inflation figures on 30th April 2019 and confirmed that the latest inflation figures gave RPI(Taxi) as 3.4% for the period March 2018 to March 2019, with the headline main RPI being 3.4% for the same period.

 

In order to reach the necessary fare increase the flag and drop prices across all tariffs will need to increase as below:

These fare changes give an overall Weighted Average Increase of 3.4% across all Tariffs, and will include a 3.4% increase to waiting time. The increase has been independently checked by the Head of Statistics.

 

There are no planned changes to the additional charges.

 

 

Recommendation

 

The Minister is recommended to agree the fare rise as detailed and approve the amendment of the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2017 accordingly.
