Jersey Teachers' Superannuation Fund: Membership of the Management Board

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Chief Minister approved the appointment of Mr Ron Amy OBE as Chairman of the Jersey Teachers’ Superannuation Fund Management Board. Mr Amy has the relevant experience to act in such a capacity as outlined in the attached Report.

Reason(s) for Decision:

It is the Chief Minister who is responsible for making Orders under the Law and for the administration of the Scheme. The current term of office for the Chairman finishes on 31st December 2009.  

The Chairman of the Jersey Teachers’ Superannuation Fund Management Board is appointed by the Chief Minister on the recommendation of the Minister for Treasury and Resources.

  1. Purpose of Report

The Chief Minister has approved the appointment of Mr Ron Amy as Chairman to the Board of Management of the Jersey Teachers’ Superannuation Fund for a three year period.

  1. Background

Paragraph 4 of the Teachers’ Superannuation (Administration) (Jersey) Order 2007 Part 2, Appointment of Chairman of Management Board requires that:- 

  • The Chairman of the Board of Management is appointed by the Chief Minister on the recommendation of the Minister for Treasury and Resources.

 

  • A person may not be appointed to be Chairman of the Management Board if he or she is a member of the Management Board.

 

  • A recommendation may only be made if it is supported by at least 3 of the member representatives and 3 of the employer representatives.

 

  • The Chairman shall hold office for the period agreed to by a majority of the member representatives and a majority of the employer representatives.

 

  • The Chairman may be removed from office in accordance with a method agreed to by a majority of the member representatives and a majority of the employer

 

  • The fee (if any) to be paid to the Chairman from the assets of the Fund shall be decided by a simple majority of the member and employer representatives.

 

The current fee agreed in April 2009 is £30,990, subject to annual review  based on the annual increase in the RPI the preceding December.  

  1.  The Proposed Appointee

 

Ron Amy is a former Chairman and Chief Executive of Aon Consulting, an actuarial and benefits consulting business, which is part of the Aon Corporation. He is a non-executive director of Aon Limited in the UK and chairman of the Compliance Committee. 

He is a graduate of Glasgow University with an honours degree in pure  mathematics.  He is a Fellow of the Faculty of Actuaries, a former board  member of the Occupational Pensions Regulatory Authority and the  Occupational Pensions Board, and a past chairman of the National  Association of Pensions Funds. 

He is the independent chairman of a number of pension scheme trustee  boards, and chair of the Review Body on Doctors’ and Dentists’  Remuneration. 

In 1998 he was awarded an OBE for services to the pensions industry.

                

  1. Recommendation of the Minister for Treasury and Resources

On the 16th December 2009, the Minister for Treasury and Resources signed a Ministerial Decision recommending the appointment of Mr Amy as Chairman. The Treasury report accompanying this confirmed that this appointment had been agreed by the Management Board and confirmed that it was also supported by at least 3 member representatives and 3 employer representatives,
