Infrastructure, Housing and Environment: 2022 Departmental Fees and Charges

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Infrastructure, Housing and Environment – 2022 Departmental Fees and Charges (excluding Jersey Car Parks and DVS).

 

Decision(s): The Minister for Infrastructure approved the Department’s infrastructure related fees and charges as set out in the attached schedules Appendix A and Appendix B.

 

Reason(s) for Decision:  To enable the Department to increase its infrastructure related fees and charges by an average of 2.5% from 1 January 2022 in order to aid towards cost recovery set out in Appendix A. Also the introduction of a new fee supported by Appendix B (exempt).

 

This Ministerial Decision excludes the charges for Driver and Vehicle Standards and Jersey Car Parks which will be under separate Ministerial Decisions.

 

The revised fees and charges will be published before they are introduced.

Resource Implications:  The additional income as a result of the proposed increases to infrastructure related fees and charges will aid the department in working towards cost recovery.

 

Action required:  Head of Finance Business Partnering to arrange for the Department’s infrastructure related fees and charges to be advertised on www.gov.je.  Officers to request the Principal Legislative Drafter to prepare an Order in respect of increases to fees under the Road Works (Permit Fees) (Jersey) Order.

2022 DEPARTMENTAL FEES AND CHARGES – INFRASTRUCTURE

 

 

Purpose of Report

The Minister for Infrastructure is asked to approve a request to amend the Department’s infrastructure related fees and charges for 2022 (a schedule of charges is attached as Appendix A).  Separate papers on DVS and Car Parking charges which require Law Drafting Instructions will follow.

 

 

Discussion

The proposed increases have been limited to 2.5% per annum in line with the anti-inflation policy, with the introduction of a new fee listed below and detailed in the attached appendix A.

 

Soil Blending Product – per m³ – up to £10.00 (excl. GST) from 1st January 2022. Supported by Appendix B.  It is requested that this is set as an “up to” fee in order to allow market conditions, product availability and acceptability of the charge to be reflected in the pricing structure.

 

Soil Improver – 40l bags – this product is for sale to the general public at the green waste reception site at La Collette.  The retail price has remained £3.00 per bag for the last 10 years whilst costs of the raw material and bagging operation have increased significantly.  It is now requested to increase this to £3.50 per bag, or a reduced price of £12.00 (formerly £10) for 4 bags (both inclusive of GST).  Due to the requirement to handle change, it is recommended to retain round sum amounts for ease of administration.  A similar increase will be applied to the “fill your own 90l bin” charge in line with raw materials costs and for consistency.

 

 

Recommendation

That the Minister approves the fees and charges for 2022 as laid out in the attached Appendix A.

 

 

Reason for Decision

To enable the Department to increase its infrastructure related fees and charges for 2022, and increase specific fees in line with supporting reports.

 

 

Resource Implications

The increased income will aid towards cost recovery for services.

 

 

Action Required

 

Head of Finance Business Partnering to arrange for the Department’s fees and charges to be advertised on the States Website, www.gov.je, and to be available on request from the department.

 

Officers to request the Law Draftsman to amend the fees in respect of Road Works and Scaffolding Charges to come into force from 1 January 2022 under the Road Works (Permit Fees) (Jersey) Order.
