Appointment of British Sea Fisheries Officers

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

To recommend that Fisheries Staff are appointed as British Sea Fisheries Officers (BSFO’s)

Background

All sea going Fisheries staff are currently appointed as Jersey Fishery Officers.

It has come to light that certain legislation in force around the Island (notably the stowage of gear order) can only be enforced by BSFO’s . While this legislation has not generally been in use it is now required to control a problem of French Fishing vessel incursion inside the 3 mile exclusive limit.

BSFO’s may be appointed by the Minister under the Sea Fisheries Act 1968 extended to Jersey by the Sea Fisheries (Channel Islands) Order 1973.

Discussion

There have been many attempts to solve the problem of foreign mobile gear boats fishing inside the 3 mile limit. But because they keep a good radar watch and Jersey Officers need to get close enough to prove actual fishing is taking place control under the current legislation has proved almost impossible with the result that certain professional Jersey fishermen have lost substantial amounts of fishing gear to the French.

The French authorities and indeed professional fishermen’s organisations have been asked to assist by senior Jersey politicians and although the French are very supportive they are not able to control individual fishermen who put fishing profit above fishing lawfully.

Therefore the only solution left is to use legislation which demands that all fishing gear is stowed properly while inside Jersey limits. It will be much more difficult for the offending vessels to abide by this legislation and continue to fish illegally and the chances of a conviction are much greater.

Both the French administrative authorities and the French fishermen’s organisations involved are supportive of Jersey’s intended actions.
