Pharmaceutical Benefit Advisory Committee: Appointment of Chair

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister decided to reappoint Alison Creed to serve as chair to the Pharmaceutical Benefit Advisory Committee.

Reason(s) for Decision:  

The Pharmaceutical Benefit Advisory Committee is the advisory body, created under the Health Insurance (Jersey) Law 1967, to provide advice to the Minister for Social Security on the items which should be placed on the Approved List and funded by Pharmaceutical benefit.  The Minister is responsible for the inclusion or deletion of items from the Approved List but first must consult with the PBAC.

The constitution of the PBAC provides that members may serve for a five year term, but that this term could be extended for a further four years.   Under Article 3 (3) of the Health Insurance (Pharmaceutical Benefit Advisory Committee) (Jersey) Order 2017, the Minister would like to reappoint Alison Creed to serve as chair to the PBAC for a further four years.

Reappointment of Chair to the Pharmaceutical Benefit Advisory Committee

 

 

The Pharmaceutical Benefit Advisory Committee (PBAC) is the advisory body, created under the Health Insurance (Jersey) Law 1967, to provide advice to the Minister for Social Security on the items which should be maintained on the Approved List and funded by Pharmaceutical benefit.   The Committee meets four times a year and consists of: 

  • A chair
  • An independent pharmaceutical advisor
  • A Social Security officer
  • The Medical Officer of Health
  • The Chief Pharmacist at the general hospital
  • Three GPs and two community pharmacists
  • A representative of dental prescribers
  • A representative of non-medical prescribers
  • The chair of the HSSD Drugs and Therapeutics Committee

 

The chair is appointed by the Minister for Social Security, to represent the views of the general public. This position (as are others on the committee) is voluntary.   

 

Alison Creed has served as chair to the PBAC for five years. Alison was initially appointed in June 2013 following a recruitment process conducted under the supervision of the Jersey Appointments Commission which met the standards required in openness, equity and impartiality.

 

The constitution of the Pharmaceutical Benefit Advisory Committee is given in the Health Insurance (Pharmaceutical Benefit Advisory committee) (Jersey) Order 2017, and allows for the five year term of service to be extended for a further 4 years. (Article 3 (3))

 

The Minister is pleased to note that the chair is willing to extend their service and hereby extends their appointment for a further four years.
