Appointments Commission: Re-Appointment of Member.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Chief Minister approved the report and proposition recommending that Advocate Rose Edith Colley be re-appointed as a member of the Appointments Commission for further term of 1 year, and agreed that the proposition should be lodged ‘au Greffe’ with a view to securing the earliest possible provisional date for debate.

Reason(s) for Decision:

The term of office of Advocate Rose Edith Colley as a member of the Jersey Appointments Commission expires in February 2008 and the Commission would like to retain her as an experienced member for a further year.  This further term would be in accordance with the requirements set out in the Employment of States of Jersey Employees (Jersey) Law 2005.

PROPOSITION  
 

THE STATES are asked to decide whether they are of opinion – 

in accordance with Article 18 (1) of the Employment of States of Jersey Employees (Jersey) Law 2005, to re-appoint Advocate Rose Edith Colley as a Commissioner to the Jersey Appointments Commission for a period of one year.

REPORT  

Appointments Commission: Reappointment of a member  
 

The Jersey Appointments Commission has been established by the States in accordance with Part 4 of the Employment of States of Jersey Employees (Jersey) Law 2005. The Commission consists of a Chairperson and not more than 4 other commissioners. 

The term of office of one of the members of the Commission, Advocate Rose Edith Colley, expires in February 2008, and Advocate Colley has indicated that she will accept a reappointment. Advocate Colley has been a member of the Commission since its establishment in July 2002 and her reappointment will be in accordance with the requirements set out in Part 4, Para 18 (5) of the Employment of States of Jersey Employees (Jersey) Law 2005.  

I would like to propose that Advocate Rose Edith Colley be reappointed as a member of the Appointments Commission with immediate effect for a period of a further year. 
 

Background  

The Appointments Commission members’ periods of office expire as follows:  

  • Mr Michael Joseph Liston – Chairman  - 23/02/10
  • Mrs Catherine Elizabeth Rees    - 23/02/10
  • Mr Brian Curtis      - 23/02/09
  • Advocate Rose Edith Colley    - 23/02/08
  • Mr Kenneth Soar     - 18/04/11

 

It is important to retain the experience of Advocate Colley, a founder member of the Commission for a further period. Mr Liston and Mrs Rees periods of office expire in 2010, therefore the reappointment of Advocate Rose Edith Colley for a period one further year will assist in maintaining continuity within the membership of the Appointments Commission. 

Financial and manpower implications: 

There are no additional resource implications arising from these proposals, as there is already a budget in place for the costs associated with the running of the Appointments Commission.
