Les Quennevais Park, Blocks D, E, F, G and H - Long Leaseholds to Flying Freehold

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Les Quennevais Park, Blocks D, E, F, G & H – Proposed Conversion of Long Leaseholds to Flying Freehold

Decision(s):

  1. With reference to the previous decision MD-PH-2011-0095 plus associated documentation and the expiry of 15 working days’ notice to the States of that decision, the Minister approved, as recommended by Jersey Property Holdings:
    1. The setting-up of Flying Freehold Associations for the properties:
      1. “Blocks D, E & F, Les Quennevais Park” comprising 36 flats and garages, together with the communal areas and land.
      2. “Block G Les Quennevais Park” comprising 12 flats and garages, together with the communal areas and land.
      3. “Block H Les Quennevais Park” comprising 12 flats and garages, together with the communal areas and land.
    2. An option to each existing Leaseholder at the properties: “Blocks D, E, F, G & H, Les Quennevais Park” to convert their Leasehold interest in their flat and garage to Flying Freehold ownership, for a consideration as set-out in the accompanying report.
    3. An option to each existing Leaseholder at the property: “Blocks D, E, F, G & H, Les Quennevais Park” who presently has use of an enclosed garden area to acquire same as part of the Flying Freehold ownership at a rate of £14.04/sq ft.
    4. That the surveyors’ and legal costs associated with setting-up the Flying Freehold Association will be met by the Public, with the Leaseholders to meet their own legal costs in becoming co-owners of the Flying Freehold Association.

Reason(s) for Decision:

  1. Under Standing Order 168 (1) (a) the Minister hereby notified the States that he had accepted the recommendation of Jersey Property Holdings to agree to the above land transaction.
  2. The Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.

 

Resource Implications:

  1. There are no financial or manpower implications in respect of this decision other than those detailed in the report.
  2. The States asset balance sheet implications of this decision will be accounted for at the date of conclusion of the transaction.

Action required:

  1. Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.
